Coleen H Sullins, Deputy Director Division of Water Quality October 27, 2008 Mr Pat Ivey, P E Division Engineer, Division 9 North Carolina Department of Transportation 375 Silas Creek Parkway Winston Salem, 27127 Subject US 70, R-2911C Rowan County DWQ No 04-1476 Dear Mr Ivey On October 8, 2008, Amy Euliss, Division of Water Quality (Division) regional staff conducted an compliance investigation on the US 70 widening project in conjunction with Mr Kent Boyer, Division Environmental Officer for NCDOT Division 9 and Phil Suggs, Roadside Environmental During the site visit, a sediment loss was discovered at the pipe outlet of UT1 to Withrow Creek on R-2911 C, permit site 4 The loss appeared to be localized This fill of a jurisdictional stream without authorization is a violation of 15A NCAC 2H 0500 Upon discovery, NCDOT further investigated the situation and repaired and improved the erosion control measures in the area Upon recommendation of the Division of Water Quality, NCDOT staff stabilized the sediment per the Division's recommendation at the outlet of the pipe Amy Euliss conducted a follow up inspection of the affected channel on October 24, 2008 and found that the restoration work and repair work were adequate The Division requested documentation of proper inspections, maintenance and rain gauge records in accordance with NCS000250 Pursuant to the NCS000250, NCDOT shall incorporate applicable requirements of the NCGO1000 These requirements state that, "visible sedimentation found outside of the disturbed limits shall be recorded and an explanation shall be kept with the records as to the measures taken to control future releases Any measures taken to clean up the sediment that has left the disturbed limits shall also be recorded " In stream sediment should be noticed during weekly roadside inspections and/ or during inspections occurring within 24 hours after any storm event greater than 0 5 inches of rain The Division should be notified within 24 hours following a sediment loss into surface waters During the field visit on October 8, 2008, on-site DOT and contractor staff informed the Division that they did not know about the sediment loss in the stream However, in the records, the sediment loss was recorded on September 16, 2008 The Division was either given false information in the field or the records were filled out after the fact Other issues with the records NCDEN N C Division of Water Quality 1650 Mail Service Center Raleigh, NC 27699-1650 (919) 733-1786 Customer Service 1 800 623-7748
