Box 160 Plumtree, NC 28644 Telephone Number 828-260-5957 Size and Location of Property (waterbody, Highway name/number, town, etc.): The site located at the Frank Volunteer Fire Department, at 699 North 19E Hwy, near Newland, North Carolina. Coordinates are: 36.0792 N and -82.0023 W. Description of Unauthorized Activity / Permit Noncompliance: The Corps issued a general permit verification (Nationwide Permit 39) on November 18, 2014 which authorized the placement of fill/pipe in 82 linear feet of stream channel and 0.01 acre of wetlands for the construction of an entrance/access to a new firehouse. The Corps has found the permittee to be in noncompliance with the issued general permit verification. There is approximately 240 linear feet of perennial stream channel and 0.02 acre of wetlands that have been filled and the work that was conducted does not match the plans that were submitted and subsequently approved. The work as described above is complete and there is no on-going construction activities on the site. Please see attached site sketch for reference and note that this is an approximate sketch/depiction based on an August 16, 2017 site visit/meeting. Indicate Which of the Following Apply: Unauthorized Activity River and Harbor Act, Section 10 (33 USC 403) X Noncompliance with Permit X Clean Water Act, Section 301 (33 USC 1311) Unless you have a Department of the Army Permit for the above described activity, it is a violation of federal law as specified above. You have agreed to do no further work in waters or wetlands without the required Department of the Army Permit. Any further unauthorized work in waters or wetlands will be considered an intentional violation of federal law. If you do no further work in waters and wetlands, and perform the remedial action requested below, the Corps of Engineers will take no further action in this matter. If you continue to work in waters and wetlands without the required authorization, and/or fail to perform the requested remedial action, the Corps will take further administrative action, and may request the U.S. Attorney to file suit against you. Remedial Action Required: A new permit application needs to be submitted requesting authorization to allow all or a portion of the unauthorized fill to remain in place. Updated/current plans should be submitted that clearly shows and calculates impacts to scale and the purposes for those impacts. Any application should include avoidance and minimization discussions as to the need for the large amount of impervious area (to include parking and helipad uses) for which the stream/wetland appears to have been filled. This application should also include a compensatory mitigation plan that will adequately compensate for any proposed impacts beyond 150 linear feet of stream channel. Information in the form of stream quality assessment forms (i.e. NCSAM) should be submitted to document any mitigation ratio below 2:1 for proposed permanent stream impacts. If on-site removal of a portion or all of the fill material is proposed, then a plan needs to be submitted to show/calculate which areas will be restored and how these impacted areas will be restored to pre -construction contours. If restoration is proposed, then a monitoring plan should be submitted as well. The above information should be submitted by September 29, 2017 to avoid referral of this matter to the U.S. Attorney and/or Environmental Protection Agency for administrative penalties and/or civil action.
