The crossing shown on Page 16 of the plan sheets, at Station 11 +00 appears to be in contradiction with this requirement. Please clarity the angle of crossing at this location and/or clarify if you are requesting an exemption from this permit condition. Exemptions from permit conditions must be clearly justified. Response to Comment. The sewer line near station 11 +00 has been shifted such that the crossing angle is within fifteen degrees of perpendicular, as shown on revised sheet 16 which is enclosed. Comment 2: Condition #19 of General Certification 3699 requires that the construction corridor through wetlands and at stream crossings be limited to 40 feet. The plans indicate a 40 foot permanent corridor, as well as an additional 10 foot construction easement through wetlands. It appears the construction corridor could be minimized in wetland areas to reduce wetland impacts in accordance with the avoidance and minimization criteria. Please modify the construction drawings appropriately to meet the permit condition and minimize unnecessary impacts. Response to Comment. We have added notes on the construction plans indicating that the construction corridor across wetlands and stream crossings throughout the project shall be minimized to 15-feet in width and construction fencing shall be installed as shown on the plans. We've enclosed revised sheets 3, 5, 6, 10, and 16. Comment 3: Condition #20 of General Certification 3699 requires that the permanent utility easement through wetlands and at stream crossings be limited to 15 feet. The plans indicate a permanent utility easement of 40 feet throughout the project. Ms. Sue Homewood NCDENR DWQ December 12, 2008 Page 2 of 2 Response to Comment: The permanent easements along Lines 100 and 101 will be used by the City in the future for a public access and utility easement. There will be a walkway in the future along these routes, adjacent to the sewer route, which is why a wider permanent easement is required. Please excuse us for not disclosing this information sooner. During the installation of the sewer line the disturbance will be limited to 15 feet, as stated in the response to comment 2 above. We respectfully request that you issue a variance for all of the stream and wetland crossings along lines 100 and 101, in light of this special circumstance. We would also like to request a variance along line 105 (sht. 16), due to the depth of the proposed sewer line. Should future maintenance be required such that the sewer line need be excavated, a width of 30 feet will be needed. Please also note that in an effort to minimize impacts to streams, we are routing a sewer line across a culvert instead of across the creek, at station 11 +00 (line 112) of sheet 22. We also have eliminated the 10' temporary construction easements along most of sheets 5 and 6, in order to minimize overall impacts.
