Ryscavage, Please reference your letter (enclosed) to Mr. Franky Thomas dated November 17, 2008 regarding the matter referenced above: No additional work has or will be done on the site until this issue is resolved, or if directed by USACE or DWQ. Attached is a completed PCN form for placement of the culvert pipe as well as additional supporting documentation. Mr. Thomas would like to leave the pipe in place and compensate by preserving additional wetlands and buffer area on the tract (approximately 2.5 acres). Measurements taken in the field on November 25, 2008 indicate that the actual impact area is 0.02 acres as shown on the attached sketch. Forty linear feet of stream was impacted by placement of the 36" pipe. SAW-2008-2579 Mr. Franklin Thomas Post Office Box 40 Leland, North Carolina 28451 Dear Mr. Thomas: November 17, 2008 This letter is in reference to the response received from your agent, Mr. Jim Vithalani of Right Angle Engineering, dated October 15, 2008, in response to the Cease and Desist letter sent by this office and received by you on September 23, 2008 regarding an unauthorized discharge of fill material into Section 404 jurisdictional waters and wetlands adjacent to the Brunswick River, located on parcel number 038BCO19 across from 102 Riverview Drive also owned by you in Leland, Brunswick County, North Carolina. This project has been assigned Department of the Army number SAW-2008-2579. Please reference this number in all future correspondence. The U.S. Army Corps of Engineers, Wilmington Regulatory Field Office (Corps), reviewed the Nationwide Permit (NWP) 26 authorization issued to you on May 17, 1991 for the discharge of fill material into waters of the United States for the construction of a road at the subject site. Your permit has expired and NWP 26 is no longer valid. The October 15, 2008 letter indicates that you were recently performing maintenance on an existing structure. As your road crossing is a previously authorized activity, the recent maintenance activity may have qualified for NWP 3; however, in order to be eligible to utilize this NWP, the previously permitted structure must be "currently serviceable". Part E. of the 2007 Nationwide Permits, published in the Federal Register on March 12, 2007, defines currently serviceable as "useable as is or with some maintenance, but not so degraded as to essentially require reconstruction". Based upon all available data and Ms. Garvey's site visit observations, the Corps does not believe that your structure, while formerly authorized, qualified for NWP 3 verification. As such, your recent activities conducted in waters of the United States, including wetlands, is a violation of Section 301 of the Clean Water Act (33 USC 1311). To resolve this violation, you must either restore the impacted wetlands and waters to pre- construction condition or obtain after-the-fact DA authorization. As we stated in our September 23, 2008 letter, if you should apply for DA authorization you will be required to demonstrate purpose and need of the project, avoid and minimize your impacts to jurisdictional waters to the C7 77r 7- 1 E7 D !TRAIL ? F;L(?LLPT RCOU"'STED -2- maximum extent practicable, and provide compensatory mitigation for lost wetland and waters function. Keep in mind that you will be required to remove all discharged fill and provide restoration to the satisfaction of this office for those areas of impacted wetlands that you do not receive after-the-fact authorization. Failure to submit either a restoration plan or an after-the-fact authorization request, in the form of a Preconstruction Notification application (copy enclosed), within two (2) weeks of receipt of this notice may result in a referral to the United States Environmental Protection Agency with a recommendation for civil action.
