Thank you for your letter dated November 18, 2008 in which you state that DWQ cannot accept out of
basin mitigation credits for the proposed wetland impacts at the Surf City Commons site. We have recently
discovered that there is a private mitigation bank, Hofmann Forest Mitigation Bank, in Onslow County that
serves this project's specific cataloging unit in the White Oak River Basin (HUC# 03030001). We have
contacted this bank and they have agreed to allow the applicant to buy non-riparian wetland credits from them.
Attached is their acceptance letter.
Please note that the applicant's address has recently changed. Attached is an updated application form
with the new information. Thank you for your assistance with this project.

18. NATURE OF ACTIVITY (Description of project, include all features) - The preferred project consists of constructing
220,000 square feet of retail/commercial space with associated parking and roads. Wetland fill for building
pads, parking lots, and roads is requested (See Project Narrative).
19. PROJECT PURPOSE (Describe the reason or purpose of the project) - To provide a commercial development within
an expanding section of Surf City (See Project Narrative).

Thank you for your interest in purchasing mitigation credits from the Hofinann Forest Wetland
Mitigation Bank. Should Hofmann Forest wetland restoration credits be deemed acceptable by
the permitting agency for the mitigation of 5.53 acres of non-riparian wetland impacts for the Surf
City Commons project [White Oak River Basin (HUC03030001; Action ID#
SAW-2008-01902,] we can offer you the ability to purchase those credits in either a 1:1 or 2:1
ratio. This letter confirms that you will be allowed to purchase the mitigation credits you require
for this project from the Hofmann Forest Wetland Mitigation Bank.
Please include the exact number of credits desired and your Action ID # in any further
