APPROVAL OF STORMWATER MANAGEMENT PLAN
Dear Mr. Niekamp,
On August 25, 2008, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to you to
place fill within or otherwise impact 250 linear feet of an unnamed tributary to Doby Creek for the purpose of
constructing the proposed "South Tract Blvd. Apartment" in Mecklenburg County. On November 10, 2008, the
401 Oversight/Express Permitting Unit of the DWQ received a stormwater management plan (SMP) dated
November 6, 2008 from your engineers Mr. Matt Edwards, PE and Ms. Beverly Rosenbloom, EI, both of Kimley-
Horn Associates for the purpose of meeting Condition 6 of the 401 Certification for this project.
The Division of Water Quality (DWQ) has reviewed the SMP and revised versions dated November 17, 2008 and
November 24, 2008 received on November 18, 2008 and November 25, 2008 respectively. The final revised plan
dated November 24, 2008, with additional information received on December 2, 2008 and December 3, 2008, has
been approved by the DWQ and satisfies the stormwater condition required by the Water Quality Certification.
You are required to meet the following conditions:
The stormwater treatment system comprising two wet detention ponds and associated stormwater
conveyances and appurtenances, the grading and drainage patterns depicted on the plans, as approved by
this office must be maintained in perpetuity. No changes to the structural stormwater practices shall be
made without written authorization from the Division of Water Quality. The stormwater management
structures shall have maintenance access and at least 10-foot drainage easement on each side to allow for
the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall
be recorded to provide protection of the structures from potential alterations by future property owners.
2. All operation and maintenance activities shall be followed as stipulated in the Operation and Maintenance
Agreement signed and notarized on December 2, 2008, and received in our office on December 3, 2008.
3. You must submit three (3) copies of an executed Declaration of Deed Restrictions and Protective
Covenants within thirty (30) days of recording with the Register of Deeds, Iredell County, North
Carolina. The recorded deed shall include the applicable items under Section IV of the Stormwater
Management Application Form received on November 18, 2008, including, but not limited to, the
maximum built upon area of any lot or parcel of land draining to the wet ponds.
4. Notification of Construction: The applicant and/or authorized agent shall contact the DWQ Express
Review Program in writing at the letterhead address within ten (10) days of the commencement of
construction.
