Wake County Stormwater Approvals. The enclosed documentation have been sent in
order to comply with Condition #8 of the Ready Mix Concrete Plant, DWQ Project #
08-0495 Approval of 401 Water Quality Certification and Authorization Certificate
per the Neuse River Buffer Protection Rules that requires an approved Stormwater
Management Plan prior to the authorized stream impacts.
Below is a list of the items enclosed with this letter:
• One (1) copy Wake County Stormwater Letter of Conditional Approval;
• One (1) copy Wake County Floodplain Management Letter of Conditional
Approval; and,
• One (1) copy of Ecosystem Enhancement Program Nutrient Offset Payment
Receipt.

Dear Mr. Lewis:
The above-referenced stormwater management plan for the creation of 101,930 square feet of impervious has
been reviewed and conditionally approved.. The project shall provide peak flow control via 1 wet detention
pond. As a condition of approval you are required to provide items 1 through 4 as noted above. The
Maintenance manual and budget, Maintenance Covenant, As-built certification and Inspection report must be
approved by Wake County prior to final signoff of the Certificate of Occupancy (C.O.) for your building
permit(s). It is very important that your contractor, engineer and yourself be aware of these additional
provisions to insure that the outstanding stormwater management requirements are submitted, reviewed,
approved and installed, such that these conditions are satisfied. See below, for Ordinance specific wording on
requirements.
1. Maintenance Plan The developer must record, and reference on the record plat, a maintenance
plan that instructs the property owner about the annual maintenance tasks and associated costs for
at least a 20-year period. It will be the responsibility of the property owner to update the
maintenance plan at least every 10 years.
2. Maintenance Agreement The developer must record, and reference on the record plat, a
maintenance agreement, or restrictive covenant that sets forth the property owner's continuing
responsibilities for maintenance.
3. Maintenance Easments The developer must record easements for access, maintenance and
inspections by Wake County Government.
4. As Built Plans Upon completion of required improvements, the developer or the developer's
representative must submit as-built plans of required stormwater improvements to the Wake
County Department of Environmental Services. These plans must indicate whether stormwater
improvements were constructed in accordance with the County approved stormwater
plan.findings.

This request for Wake County to evaluate a stormwater management plan does not relieve the applicant
from their responsibility to meet all applicable State and Federal Laws, including, but not limited to
necessary approvals from Federal Emergency Management Area Flood regulations/requirements,
Division of Water Quality stormwater or other water quality regulations/requirements, U.S. Army Corps
of Engineers Article 404/401 (Wetlands/Streams) jurisdiction/requirements, and/or any Federal, State,
County and Local municipal regulations or permit requirements. The approval issued in this letter cannot
supersede any other required permit or approval.

The subject flood study has been reviewed and it has been determined that the study adequately represents the
hydrologic and hydraulic properties of the proposed development. Therefore, in accordance with Article 14. Flood
Hazard Areas of the Wake County Unified Development Ordinance, your flood study is hereby Approved with
the following Conditions:
1. That the proposed development is constructed in accordance with the construction details and
specifications proposed in the study.
That the new flood backwater limits be duly recorded on the Construction Drawings and Final Plat for the
project and future landowner(s). Use HW 100 elevation of 262.64 at the culvert pipe based on topography
of field surveyed flood limits. Pipe material approved for 60" Reinforced Concrete Pipe (RCP). Add
standard flood hazard notes and asterisks (*) to any lot with flood hazard areas with a Finished Floor
Elevation for any Habitable Structure of 263.6 based on Flood-study benchmark. Secure and record any
necessary backwater encroachment easements prior to installation of pipe culverts.
That certification of as built compliance with the Construction Drawings is required prior to releasing
Certificate of Occupancy or this requirement may be added to the letter of credit. It is very important that
your contractor, designer, clients and yourself be aware of this requirement to insure that the site plan is
carefully adhered to, such that this condition is met.
This request for Wake County to approve the Flood Study Report does not relieve the applicant from her or his
responsibility to meet all applicable State and Federal Laws, including, but not limited to necessary approvals from
Federal Emergency Management Area Flood regulations/requirements, Division of Water Quality stormwater or
other water quality regulations/requirements, U.S. Army Corps of Engineers Article 404/401 (Wetlands/Streams)
jurisdiction/requirements, Neuse River Riparian Area Protection and Maintenance Rule (I SA NCAC 213.0233)
and/or any Federal, State, County and Local municipal regulations or permit requirements. The approval issued in
this letter cannot supersede any other required permit or approval.

Ecosystem Enhancement Program" (NC EEP), sent to the attention of Ms. Kelly Williams with the N.C.
Ecosystem Enhancement Program: 1652 Mail Service Center, Raleigh, North Carolina 27699-1652. As
an option, you may hand deliver it to 2728 Capital Blvd., Suite 1H 103, Raleigh, NC 27604. Ms.
Williams can be reached at 919-716-1921. A payment Receipt letter from the NC EEP is required prior
to the release of the Stormwater Permit.

You have elected to fulfill your permitted nutrient requirements by paying into the EEP Nutrient Offset
In-Lieu Fee Mitigation Program. The North Carolina Ecosystem Enhancement Program has received payment
for nutrient offset for the referenced project as indicated above. The named Local Government specified and
verified the amount of the offset necessary for permit approval. Nutrient offset payments made to EEP as part of
fulfilling the requirements of the Neuse River Nutrient Sensitive Waters Management Strategy shall be at a rate
specified in 15A NCAC 0213.0240 and Session Law 2007-438.
You must also comply with any other state, federal or local government permits or authorization associated with
this activity. Payments into the Nutrient Offset Program are not transferable. If you have any questions or need

Please note that a payment to the Ecosystem Enhancement Program is not reimbursable unless a request for
reimbursement.is received within 12 months of the date of this receipt. Any such requests must be accompanied
