SUBJECT Pipe Replacement on SR-1207 (Leatherman Road), Lincoln County
Dear Mr Lund
The North Carolina Department of Transportation requests authorization to replace an existing
pipe on SR-1207 (Leatherman Road) in Lincoln County NCDOT proposes to replace a
deteriorating 60-foot long, 36" CMP with a 72-foot long, 36" RCP Ten feet of Class B riprap
will be used at the pipe inlet and outlet for structural stabilization The roadway embankment is
collapsing at the outlet end and there is a concern for public safety, therefore, this project is
considered an emergency project and construction will commence immediately The stream is
low flow stream which is located in a pasture with livestock access and contains limited aquatic
life The existing pipe on 4 3% slope, therefore, it anticipated that required pipe burial will result
in upstream channel destabilization, therefore, the new pipe will be placed on existing streambed
grade Due to the existing site conditions, NCDOT requests a waiver from the Regional
Conditions 2(b) (e) permit depth specification for the construction of this project.
A temporary cofferdam pumping system will be used to divert the stream around the
construction site as needed Upon project completion, areas affected by temporary cofferdam
system will be graded and restored back to pre-project conditions All Best Management
Practice's will be utilized during the construction of the project The scope of the work will
result in 22 feet of permanent impacts to an unnamed tributary to Howard's Creek, which is
classified as Class C Waters by the Division of Water Quality
The project area is not located within '/z mile of a critical watershed area nor is SR 1207 a rural
or urban arterial, therefore, hazardous spill basins are not required Enclosed is a hazardous spill
basin checklist This office has conducted a GIS and field survey for the project for historical

sites and threatened/endangered species No sites listed on the National Register of Historic
Places are located in the vicinity of the project nor did there appear to be any eligible structures
There will be no cffcct on effect on historical structures The federally listed species for Lincoln
County (USFWS list dated January 31, 2008) include Michaux's sumac (Rhus michauxu) and
dwarf flowered heartleaf (Hexastylis naniflora)
Natural Heritage Program records document the nearest Michaux's sumac location
approximately 23 miles southeast (in Mecklenburg County) of the proposed project area There
are no known sites of Michaux's sumac in Lincoln County The sumac is typically found in
sandy or rocky, open woods and appears to survive best in areas with some disturbance, such as
artificially or naturally maintained clearings There is no potential habitat within the proposed
project area, and no species were observed during the site visit No impact on the species is
anticipated National Heritage Program records document the nearest Dwarf-flowered heartleaf
location approximately 2 3 miles northwest of the proposed project area The heartleaf is usually
found on dry to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type)
and in boggy areas near springheads There is no suitable habitat within the proposed project
area and no species were observed NCDOT is recommending a finding of "no effect" for T&E
species
I have enclosed a pre-construction notification for a NW#14, sketches of planned activities and
location maps relative to the project

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties Both the vicinity map
and site plan must include a scale and north arrow The specific footprints of all buildings

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible Also discuss how impacts
were minimized once the desired site plan was developed If applicable discuss construction
techniques to be followed during construction to reduce impacts The existing pipe must be
replaced for the safety of the travelling public Minimal amount of riprap used for structure
stabilization Due to the slope of the proposed pipe the new pipe will be placed on existing
streambed grade to prevent upstream channel destabilization
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H 0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on January 15, 2002, mitigation will be required when
necessary to ensure that adverse effects to the aquatic enviionnient are minimal Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed Examples of mitigation that may be appropriate and practicable include,
but are not limited to reducing the size of the project, establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams, and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing Any application
lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete
An applicant may also choose to review the current guidelines for stream restoration in DWQ's
