REQUEST FOR MORE INFORMATION
Dear Mr. Horton:
On October 13, 2008, the Division of Water Quality (DWQ) received your application dated August 22,
2008, to fill or otherwise impact 65 linear feet of perennial stream, 40 linear feet of intermittent stream,
and 11,259 square feet of Zone 1 Neuse River basin protected riparian buffer, and 12,597 square feet of
Zone 2 Neuse River basin protected riparian buffer 47 to rehabilitate or replace the existing sewer
interceptor at the site. On November 5, 2008, the DWQ received additional information from you,
however, the DWQ has determined that your application remains incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetlands and/or streams on the subject property. Therefore, unless we
receive five copies of the additional information requested below, we will place this project on hold as
incomplete until we receive this additional information. If we do not receive the requested information,
your project will be formally returned as incomplete. Please provide the following information so that we
may continue to review your project.
Additional Information Requested:
1. Your NC EEP buffer mitigation acceptance letter has expired. Please provide an updated NC
EEP buffer mitigation acceptance letter.
2. You have proposed to conduct this project under a USCACE Nationwide Permit No. 12.
However, our corresponding General Certification No. 3699 states the following:
This General Certification does not authorize any permanent changes in pre-construction
elevation contours in waters or wetlands or stream dimension, pattern or profile.
Based on your response in Section VII of your PCN application, it appears you will need to
contact the USACE to inquire as to whether they can permit this project under an additional or
alternative Nationwide Permit.
