I wanted to thank you for your assistance in this matter, and your suggestion of sending an email to Dave on this matter. He called me just moments before I was ready to send it out. We had a good discussion about it, and he indicated that he will try to get someone at the Corps to send me a reply on the matter tomorrow, in that he will be out of the office. If it is possible for you to do the same, that would also be much appreciated, in that we need to be mobilizing on the project and putting the contracts in place to move forward with this plan. Please note at the end of the email to Dave I provided the Mining Permit number and location that he requested, which I should have provided to you as well, but do not recall that I had given you the specifics. Our company, Sampson Contracting, Inc., has been awarded the subject dredging project by the US Coast Guard. Our proposal for completing the project entails a step to obtain additional drying of the dredged spoil that was not addressed by the Coast Guard’s description of the dredging process. The Coast Guard has asked that we make contact with appropriate permitting and certification authorities to ensure that our plans will be in conformance with state and federal requirements. Our intent is to follow all of the requirements and conditions that have been placed in both the USACOE Permit and the NC 401 Water Quality Certification that have been made applicable to this project. At present, we do not believe it will be either necessary or fruitful to attempt to dewater this material within the very small area provided by the Coast Guard on-site their facility in Atlantic Beach, NC. We do intend to achieve a dryer spoil prior to tipping the material at one of the Coast Guard-designated land-fill facilities. To this end, we have made arrangements to utilize a NC permitted sand-mine facility on the way to the land-fill sites. Once we have achieved the desired level of drying of the material, it will then be trucked on to one of the two approved land-fill locations. 1 The sand-mine facility that we intend to utilize for drying of the spoil has a stockpile and loading area designated in the mining permit, and it is within these areas in which we intend to dry the spoil material. These areas are located on high ground, well away from any State or federal waters. While there do exist some 404 wetlands on the site, the Mining Permit requires a 50-ft undisturbed buffer between the wetlands and site activities, with a silt-fence separating the buffer from active areas of the mine. We intend to observe these requirements while utilizing this location. In addition, we are working with the property owner, (the Mining Permit holder), to provide information on the intended operations to the NC Mining Commission, and DENR Land Quality, so that any revisions, or additional requirements for handling the material can be addressed on the existing Permit. It is our intent to carefully comply with the Corps Permit Condition: “This permit does not authorize temporary placement or double handling of the excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project.” At the drying site, and at any other location used for change in mode of transportation, or loading or offloading, the material will not be placed within waters or wetlands, and all sedimentation and erosion control provisions applicable will be met. We respectfully request your feedback on this proposal, so that we can relay this information to the Coast Guard as they have requested. Boyer, of the Land Quality Section, NC DENR, Division of Land Resources; located between Highway 101 and Hardesty Loop Road, approximately 1.5 miles west of the 101 Core Creek bridge. 2
