Accordingly, we are forwarding the modified permit sections. Insert the new pages into your existing permit; you may remove the previous versions of these pages. This permit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This modified permit includes the following changes from your current permit: ➢ Ammonia limits and monitoring have been deleted. ➢ A quarterly limit for Chronic Toxicity has been added. See A. (2) for details. If any parts, measurement frequencies or sampling requirements contained in this modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. (2) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed. If reporting pass/fail results using the parameter code TGP3B, DWQ Form AT-1 (original) is sent to the below address. If reporting Chronic Value results using the parameter code THP3B, DWQ Form AT-3 (original) is to be sent to the following address: Attention: NC DENR / DWQ / Environmental Sciences Section 1621 Mail Service Center Raleigh, Forth Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently then required by this permit, the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms submitted. ' NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. It doesn't matter to me which months are chosen for testing, however, I know they did run a WET test already in the month of March (if that has any bearing on the decision). Don't forget to add the WET Testing to the Table. Remove contact lenses after the first 5 minutes and continue washing. Obtain prompt medical attention, preferably from an ophthalmologist, but flush first! Skin Contact Remove material from skin immediately by washing with soap and plenty of water for at least 15 minutes. Remove contaminated clothing and shoes while washing. Shower with soap and water. Seek medical attention, if irritation persists. Launder contaminated clothing before reuse. Destroy items which cannot be decontaminated, including leather articles such as shoes, belts, and watchbands. Inhalation Move person to fresh air. If person is not breathing, call 911 or an ambulance, then give artificial respiration (if by mouth use rescuer protection — pocket mask, etc.) Call a poison control center or doctor for further treatment advice. Ingestion Call a physician or poison control center immediately for treatment advice. Rinse mouth with cold water, then have person sip a glass of water if able to swallow. Do Not Induce Vomiting unless told to do so by the poison control center or doctor. Never give anything by mouth to an unconscious person. Note to If burn is present, treat as any thermal burn, after decontamination. No special antidote. Accidental Release Measures Large Spill and Leak WARNING: KEEP SPILLS AND CLEAN-UP RESIDUALS OUT OF MUNICIPAL SEWERS AND OPEN BODIES OF WATER. Wear protective equipment as specified in Section 10. Respiratory protection and appropriate personal protective equipment should be worn. Absorb material with vermiculite, dirt or sand. Collect material in suitable and properly labeled containers. Remove to well - ventilated area. Attempt to neutralize by adding such materials as soda ash, sodium bicarbonate, l0% caustic and alkaline soap and water. Special Sensitivity / Do not discharge this product or water containing this product into lakes, streams, ponds estuaries, Precautions oceans, or other waters unless in accordance with the requirements of a National Pollutant Discharge Elimination (NPDES) permit and the permitting authority has been notified in writing prior to discharge Do not discharge effluent containing this product into sewer systems without previously notifying the local sewage treatment plant authority. For guidance, contact your State Water Board or Regional Office of the EPA. Avoid temperatures above 158°F (70°C). Product can decompose at elevated temperatures. Generation of gas during decomposition can cause pressure MSDS - SELcide 401 Page 2 of 4 AMMONIA TOXICITYPOLICY In 1990 the EPA decreed that each delegated State develop controls on ammonia as a toxicant (after years of considering it to be primarily an oxygen -consuming waste). North Carolina uses two instream criteria adopted from EPA research: • Summer instream criteria= 1.0 mg/L • Winter instream criteria = 1.8 mg/L (Note: These are called "criteria" because standards have not been formally adopted for non -trout classified waters in North Carolina.) In order to evaluate whether the discharge has the potential to cause instream toxicity, the allowable effluent concentrations of ammonia (summer and winter) are calculated with the mass balance equation (using the IWC Excel Spreadsheet in Appendix A). Both summer 7Q10 and winter 7Q10 are used in the equation. Ammonia is the only toxicant that is limited differently for summer and winter seasons. An upstream concentration of 0.22 mg/L is assumed. If the allowable concentration is greater than 35 mg/L, no limit should be imposed. If the allowable concentration is less than 35 mg/L, potential toxicity may be occurring. If there was already an existing ammonia limit based on oxygen -consumption, the more stringent ammonia limit should be placed in the permit. If the mass balance calculation indicates the need for ammonia limits, it is Division policy to set limits no more stringent than 2 mg/L (summer) and 4 mg/L (winter) for small discharges (those less than 1.0 MGD). This is based on the Division's determination of BAT (best -available technology) for these types of facilities. Therefore, even if the calculation for a winter ammonia limit yields a 3.5 mg/L result, a 4 mg/L limit would be given. For any new or expanded flow, an ammonia limit should be given j However, for existing flows where potential toxicity may be occ e permit holder shoul e given the option to have the ammonia limit(s) placed in their permit or to have a quarterly chronic, WET test, pass/fail at the instream waste concentration using Ceriodaphnia as the test organism. Many times the facility will need a compliance schedule to be placed in the permit in order for renovations to be made at the site. Such schedules should be coordinated with the regional office and the permit holder but should not exceed three years. (GeoSci) is pleased to present this request for a modification to NPDES Permit # NC0038822. This request is in response to NOV(s) issued from the WSRO related to NH3 discharge limit exceedances and is based on various correspondences with Mr. Tedder. Mr. Tedder indicated that "in lieu of ammonia limits, the facility may choose to sample for toxicity using a chronic WET test, pass/fail at 90% using Ceriodaphnia as the test organism." Furthermore, if compliance with Chronic Toxicity (CT) testing could be demonstrated, then a request would be justified to rescind the current effluent limits for NH3 as indicated in Section A.1 of the current permit and replace them with the Pass/Fail limits for Chronic Toxicity. GeoSci contacted Jim Chesire at Research & Analytical Laboratories (R&A) in Kernersville, NC and requested that they perform two CT tests on the effluent. R&A operates the wastewater system at this facility and performs the required effluent analyses. R&A performed CT testing on March 3 and March 9, 2009 and again on March 31 and April 3, 2009. The analyses results indicated `PASS' for both tests. Copies of the certified laboratory analyses results and accompanying Chain of Custody documents are attached. Based on these results, Central Care Inc. requests that the NH3 effluent limits contained in the current discharge permit be replaced by Chronic Toxicity testing. As you know Central Care in Surry county (NC0038822) has had NH3 violations for the past 12 plus months. They have a long history with NH3 problems. After pulling out the old zero flow policies I suggested to them that they run a tox test just to see the results. in looking at the NH3 values I thought they had a chance to pass the test and they did. I've told them to run one more and if it passes to request a minor permit mod to drop the NH3 limit and include a tox. sure wish I had thought of this a year ago cause it sure would have saved them a ton of money. Personally I'd repeat the test one more time to be sure. I'd repeat it asap and if the second one passes I would then send in a letter to the Permitting unit in Raleigh (attn. charles weaver) indicating that the permitee is requesting a minor permit modification and request the tox requirement in place of the NH3 limit. Cc me on the letter. I will be taking this into consideration on any additional NH3 permit exceedences until we can get the permit resolved. I hit them pretty hard last month and I think it sunk in. They have had certification staff out for TA and have contacted three `consultants to evaluate options. Looking at some new technology for bugs as well as ,recirculating sand filter and on site possibilities. ',; They would prefer to tie onto the city of Mount Airy but they are on the wrong side :'of US 74. They have been hoping the city would run lines under the interstate, but that does not look like it will happen in the near future. ;,Their history does look bad and they have been assessed about every month for the ;past two years. they have paid them all.
