Dear Ms. Higgins:
The purpose of this letter is to the appeal the June 16, 2017, riparian buffer determination for
143 -acre industrial tract that Nash County and the Carolinas Gateway Partnership have been
marketing for almost eight years. The following describes the basis of this appeal:
1. When the 2010 determination expired, the owner requested a renewal. The 2017
determination should not have extended feature A start point well to the south through the
agricultural ditch/hedge row, even "off of property". This call is much farther past stream
feature markings shown on regulatory maps such as the USGS Quad map.
2. The ephemeral/perennial point (Al - feature A start) is as shown in 2010, right near the
eastern property boundary, upstream of the confluence with the farm ditch/hedge row. This
feature was reviewed back in 2010 and determined to be the same order historical stream
with some natural stream features such as sinuosity, bed and bank and abutting wetlands
etc. Point A appears to be the origin of this stream feature in a natural riparian headwater
wetland at the eastern property boundary.
3. The stop of feature call in 2017 in the open historic agricultural field near NC Highway 97 is
consistent with the 2010 call because of the existing agricultural ongoing use allowance in
the buffer rules. Since the agricultural fields on this site were in existence prior to the Tar -
Pamlico riparian buffer rules, we feel that the same allowance should apply to the farm
ditch/hedge row in the southern part of the property mentioned above.
We think this ongoing usage allowance should be considered, especially in the southern
reaches of this feature where no features are even shown on the re_gulatory maps. This
ditch/hedge row feature is very straight and deeply incised and has other manmade

characteristics and appears to be partly dug through high ground to drain adjacent
agricultural fields.
4. No development or changes in the field have occurred at the site since the original
determination dated October 8, 2010. The conflicting buffer determinations greatly affect
potential development at the site... and adjacent properties to the south.
On behalf of the owner, we are requesting that a revised determination letter be provided
detailing the riparian buffers as shown on the attached maps.

Dear Mr. Davis:
On October 5, 2010, at your request, Lia Myatt Gilleski and Joseph Gyainfi conducted an on-site
determination to review two stream features located oil the subject property for applicability to the Tar -
Pamlico Buffer Rules (15A NCAC 213 .0259). The features are labeled as "A" and "13" oil the attached
maps initialed by Lia M. Gilleski on October 8, 2010. T11c Division of Water Quality (DWQ) has
determined that (11C following,:
• Feature `'A" is subject to rice Neuse Buffer Rule oil the property at the flag labeled "A I —
Perennial stream begins". The feature transitions from an ephemeral stream to a perennial stream
at that point. The two agricultural ponds adjacent to feature A (shown on tile USES topographic
map) are not subject to the buffer rule.
• FcatttN "13" is not subject to the Neuse Buffer Rule. The feature is an ephemeral stream.
This on-site determination shall expire Five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWQ that a surface water exists and that it is subject to
the buffer rule may request a determination by the Direetor. A request for a determination by the Dircctor
shall be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review
Permitting; Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date
that you receive this letter. Applicants are hereby notified that the 60 -day statutory appeal time does not
start until the affected party (including downstream and adjacent landowners) is notified of this decision.
This determination is final and binding; unless you ask for a hearing within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the
buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the
