REQUEST FOR MORE INFORMATION
Dear Mr. Wilson:
On May 15, 2008, the Division of Water Quality (DWQ) received your application dated May
15, 2008, to fill or otherwise impact 0.093 acres of 404/wetland (0.092 acres permanent impact
and 0.001 acres temporary impact), 82 linear feet perennial stream impact (60 linear feet
permanent impact and 22 linear feet temporary impact), and 5,016 square feet of Zone 1 Neuse
River basin protected riparian buffers and 3,013 square feet of Zone 2 Neuse River basin
protected riparian buffers to construct the commercial development at the site. On July 18, 2008,
and September 29, 2008, the DWQ received additional information from you, however, the
DWQ has determined that your application remains incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to
process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive five copies of the additional information requested below, we will
place this project on hold as incomplete until we receive this additional information. If we do
not receive the requested information, your project will be formally returned as incomplete.
Please provide the following information so that we may continue to review your project.
Additional Information Requested:
The Stormwater Management Plan that was approved by the Town of Apex on September 24,
2008 fails to meet the requirements of its local Phase II Program because no stormwater
treatment has been provided for the-parking -lot -adjacent to the stream. Because of this, the
DWQ can not accept the locally approved stormwater management program as meeting the
requirements of the 401 Certification Program. Please submit a revised stormwater management
plan to the DWQ for review and approval that includes the following items:

A stormwater management plan that removes a minimum of 85 percent TSS and 30
percent TN from the stormwater generated by the entire project including all parking
areas), For each proposed BMP, please provide a completed BMP Supplement Form,
with all the required items. The BMP Supplement Forms are available at the following
web site: http://h2o.enr.state.nc.us/su/bmp forms.htm.
2. The Required Items Checklist portion of the Sand Filter Supplement Form, with all
required items attached. In this information, please provide boring data to show the level
of the seasonal high water table (SHWT) within the proposed footprint of the sand filter.
The BMP Manual requires that there be at least a two-foot separation between the invert
of the sand filter and the SHWT. Since the Sand Filter has been sited adjacent to a
wetland, it seems likely that the SHWT is too high to provide the needed separation. If
the SHWT is too high to allow for a sand filter, then please either relocate the sand filter
to higher ground if possible or provide a more appropriate BMP for an area with a high
groundwater table.
Please submit this information within 30 calendar days of the date of this letter. If we do not
receive this requested information within 30 calendar days of the date of this letter, your project
will be withdrawn and you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian

to discuss this matter.
