With personnel changes, the creation of EEP and the transfer of these sites from DOT it has been difficult to maintain the institutional knowledge necessary for being sure these projects were all handled similarly. While your work should settle the US 421 project, the same issues are present with the I-26 project in Madison County (T.I.P. No. A-0010). There are 5 project sites associated with this project that will be proposed for closeout within the next year (Charles, Fosson, Barnhill,. Brigmon, and Phillips/Willis. These were permitted as follows: USACE Action ID 199505135; DWQ ??. I have attached the USACE information that I have for your reference. After further file diving & interpretation, DWQ has settled the mitigation ratio issue related to the WRC stream enhancement projects that were part of the mitigation package for the US 421 relocation (TIP R-529, DWQ # 97-0616, COE # 199707161). We reviewed the original Certification (April 20, 1998) and subsequent modifications (Feb 19, 2002; Nov 6, 2002) and the contract between NCDOT and NCWRC (unsigned version in the March 27, 1998 Mitigation Strategy). Based on these documents, we believe that DWQ handled mitigation ratios as permit decisions, requiring 1:1 mitigation of 7407 linear feet (as enhancement activities described in the DOT-WRC contract) and 2:1 mitigation for 918.4 linear feet (via purchase of 1837 linear feet of stream mitigation from WRP). Therefore, as the PACG-TC works toward closeout of the Miller and Wild sites, we will consider the bank stabilization and other enhancement activities conducted under the DOT-WRC contract as having met the 401 Certification conditions without applying further ratios. We'll revise our closeout memo after the site visits next week, but I thought you might like to know that one of the issues with 2008 closeouts is no longer an issue.
