PROJECT SUMMARY: This project is being proposed as a major modification to Major Permit # 128-00. The applicant proposes to revise the original subdivision/marina development previously authorized. Narrative Description: The Mariners Village at Snug Harbor project is located at 252 Highway 70 East. The property lies adjacent to Nelson Bay in the community of Stacy, in eastern Carteret County. The tract is bordered by US 70 to the North, Salter's Creek and the Salter's Creek Bridge (NCDOT Bridge #45) to the east, and Nelson Bay to the south. Old highway 70 extends across the project property and has been abandoned. Mariners Village at Snug harbor is 62.20 acres in its entirety and is an average of 5' above NHW. A large portion of this tract has been designated by the NC NRCS as wetland that has been prior converted for agricultural use or PC fields. The southern boundary of this property is bordered by coastal marsh comprised predominately of Juncus roemerianus , Spartina alterniflora, Spartina patens, Salicornia syy, Cladium jamaicense, and Typha spy. The system transitions landward into Section 404 Wetlands, typified with a shrub system of Iva frutescens, Baccharis halimifolia, Magnolia vir ing iana, Junioerus virginiana, transitioning again to a forested wetland with pines, oaks and sweet gum, with an under story of catbrier and switch cane. The Section 404 delineation has been approved by the US Army Corps of Engineers, and is on file. Typical soils on the tract are Leon and Hoebucken muck. The Carteret County Land Use Plan classifies this property as Rural, with all AEC's classified Conservation. Neither Nelson Bay nor Salter's Creek are designated Primary Nursery Areas. Both are closed to the taking of Shellfish, and both,carry water classifications of SC. The adjoining waters of Core Sound are classified SA-ORW. Substrate in Nelson Bay and Salter's Creek is mostly silt and sand, with beds of SAV's in the vicinity. The tidal amplitude in upper Nelson Bay is approximately 1'. Proiect Description: The previous major modification to permit # 128-00, which was issued on August 22, 2007, authorized the addition of 20 acres to the original 42 acre tract, an increase in the # of residential lots to 86, the relocation and redesign of amenity facilities and support utilities, the addition of a River club facility with a pedestrian pier, a swimming pool, and minor adjustments to the marina basin configuration, entrance channel and circulation channel. The applicant's current proposal for the subdivision is to convert the 62.20-acre tract into 37 cluster lots, 7 bungalow lots, 15 villa units and 9 cottages for a total of 86 lots, an inn, ship store, restaurant, recreational amenities, pier, marina and four gazebos. The proposal also includes a Field Investigation Report: Snug Harbor Partners LLC Page 03 vinyl bulkhead, wooden bridge and pvc culvert. The pool location has also been relocated to be adjacent to the inn while the ship's store, restaurant, office, fuel tanks and parking area are still located in the area originally approved under Major Permit # 128-00. The average lot size has been reduced from 20,000 square feet to 16,223 square feet with a minimum lot size of 3,174 square feet. Of this, the development infrastructure, amenities and lots would use 15.0%. The impervious area would be reduced from the previous 17% to 15% within the 75' AEC. Once built out the entire subdivision tract would have a total of 20% impervious coverage. The buildings would be comprised of different footprints. The inn would be 480' x 1380', the outfitter club at 370' x 435', the typical villa building would be 385' x 975, the single family home at 310' x 340', the ship store at 230' x 480', the cottage at 170' x 225', the typical town home building would be 465' x 325' and the bungalow would be 205' x 410'. There would be three upland wooden gazebos proposed. One would be 20'x 40' and located adjacent to the north side of the connector channel at lot 26, the second would be 15' x 30' and located adjacent to the south side of the marina basin across from lot 14 and 15 and the third would be 15' x15' and adjacent to the pedestrian connector between lots B3 and B4. All pedestrian connectors and walkways would be concrete or brick outside of the 30' buffer and slatted elevated wood inside of the 30' buffer. There would be 75 asphalt parking spaces located at the village center with gravel drives located at the individual homes (total 86 lots). All roads would consist of asphalt with a width of 25' with the exception of the bungalow areas. They would have a circular gravel drive with individual driveways located at each bungalow. Each road would be bordered by grass vegetated swales. There would be a cul-de-sac on MarshGrass court with a radius of 80.'. The main road, which is Snug Harbor Lane, would be 25' wide and end at a rectangular cul-de-sac with a grass middle and an area of 9' x 20'. Boat Slip Lane would also follow the configuration of the main road and intersect with Bayside Place. This road would also end in a rectangular cul-de-sac. There would be 14' alleyways, which are designated in certain areas as shown on the plats. The applicant proposes to stabilize the sides of the access channel and the basin with a vinyl bulkhead. The bulkhead would start 315' from the waterward edge of the marsh along the existing marina channel on the east side adjacent to Salter's Creek. It would extend for approximately 340' west until it reaches the mouth of the marina basin. It would then continue around the basin for a total of 1190' and connect with the south side of the existing channel and continue for 340'. The total amount of bulkhead proposed would be 1870'. The applicants are proposing a 10' x 100' footbridge over the proposed circulation channel to help residents access different areas of the property. The bridge would be a minimum of three feet above substrate and would not affect any navigable waters or coastal wetlands. The water depths at NLW are approximately -.5'. Snug Harbor LLC proposes a 30-inch wide by 215' long pvc culvert to be installed. This would be dug from high ground and installed at an average depth of 10 inches from existing grade. The purpose of this culvert would be to connect the basin to the circulation channel. The culvert permitted by the previous permit was for a 30" wide pvc pipe and 170' long. The marina basin and channel have previously been excavated to a depth of -3' at NLW, Field Investigation Report: Snug Harbor Partners LLC Page 04 however the applicants wish to widen a 15' x 340' area for the existing channel from a depth of + 5' NLW to a final depth of - 3' NLW. This would remove 1,500 cubic yards of material. They are proposing a wooden boardwalk with dimensions of 6' x 1190'. It would be located as part of the cap for the bulkhead and over high ground. This would follow the same path as the proposed bulkhead around the channel and basin. They are proposing 53 slips in the marina basin, which is what was previously permitted. The slips would be numbered 1-53 and would have 27 finger piers with dimensions of 5' x 15'. They are proposing 84 tie pilings within the slip areas. The typical boats to be served would be charter, mixed types with a typical boat length of 22' to 42' with a maximum of 45'. A new pier configuration is proposed. The pier would cross a 30' area of high ground and continue over 20' of jurisdictional wetlands. It would continue for 190' over open water and then intersect with a 15' x 15' gazebo platform. The total width of the pier would be 6' and a total length of 235'. The water depth at the end of the proposed pier and platform is -.74 NLW. The pier would be used for observation only. The applicants are permitted for a package treatment plant on the north west side of highway 70, however they would need to expand the size of the plant due to more home sites and would need to install all infrastructure, which includes all utilities, within the road right of ways and pump to the treatment plant. A well would also still be installed on the northwest parcel across highway 70 as previously permitted. - 11. Anticipated Impacts: The proposed subdivision would result in the creation of a total of 86 lots. The proposed pier and wood walk bridge would shade a total of 120ft2 of jurisdictional wetlands. The pier, platform and finger piers would shade 3,390 ft2 and incorporate 37,385 ft2 of open waters. The setting of pilings would cause temporary turbidity. A total of 40 ft2 of jurisdictional wetlands and 5100 ft2 of high ground would be dredged for the widening of the access channel for the basin with no change to the existing boat basin. The number of slips will remain the same as previously permitted. Once built out, this development would be 15.0% impervious within the 75' AEC and 20% impervious for the entire tract. The proposed development program and land plan is a modification of a plan for the property approved in 2000 through the issuance of Major CAMA Permit #128-00 and through Preliminary Subdivision Plat approval by Carteret County. Permit #128-00 was renewed in January 2006. A modification to Permit #128-00 was approved in August 2007. Snug Harbor Partners, LLC, the current property owners, are requesting a modification to CAMA Permit #128-00 to reflect a change in the site plan; an increase in the number of residential lots/units; the relocation of the amenity facilities and support utilities, an Inn/Clubhouse facility, a Ship's Store/Cafe, Villa buildings, a swimming pool and a minor adjustment to the circulation channel. A revised Preliminary Plat for these modifications was submitted and is presently in review by Carteret County. Modified stormwater plans, erosion control plans and utility plans prepared in support of the CAMA permit modification request have been submitted to the respective review agencies and are currently under plan review. The marina basin, open water channel and canal have been excavated and stabilized along with a construction access roadway and a spoil facility. Bulkheads and slip facilities have not been constructed to date. The following summarizes the primary differences between the permitted and the proposed modification to the development plans. Upland Development The proposed plan has eliminated the minimum 20,000 square foot lots and reconfigured the lots to a cluster development arrangement with a minimum lot size of 3,174 square feet. The average lot size is 16,223 square feet. The lot configuration has changed, and the lot count has increased to%lots. There is also an addition of 15 villa units. An Inn with guest rooms, cottages, fitness center meeting rooms and club are also new to this plan. The previously approved pool has been relocated to be adjacent to the Inn while the ship's store, restaurant, office, fuel tanks and parking area are still located in the general area as approved under Major CAMA Permit # 128-00. The river club (now called the Outfitters Club), pedestrian pier and gazebo are still included in the project amenities. A low density best management practice (BMP) strategy has been prepared for the property to protect the marina waters and adjacent waters from stormwater run-off pollutants. The project has been designed under the low density provision of the NC Division of Water Quality stormwater regulations. Infiltration basins and closed end roadside swales will be employed to minimize the stormwater fun-off into the marina basin. The residential lots surrounding the basin will be graded to direct most stormwater away from the basin and the surrounding waters. Marina Basin The Marina facility is currently permitted for 53 commercial and residential boat slips with fuel service and sewerage pump-out facilities. The constructed basin and entrance channel and canal were dredged to a depth of -3.0 feet NLW to match the depth of the connecting channel, Salter Creek, which is also at a current depth of -3.0 feet NLW. The current permit allows the basin to be dug to a depth of minus 3.0 feet NLW and the connecting channel to a depth of minus 3.0 feet NLW. The final depth of the basin and channel will not exceed the depth of the adjacent connecting navigable channel, Salter's Creek, which was surveyed to be minus 6.5 feet NLW in 1999. The connecting channel and marina basin will be bulkheaded with approximately 2,000 linear foot of upland bulkhead. -Minor adjustment of the circulation canal. The circulation canal is designed to encourage additional flushing for the marina basin by providing a second outlet to the surrounding waters. The dissolved oxygen model does not use the circulation canal as a value in determining projected DO levels. The 30" pipe will be modified in length from 170' to 215'. A Dissolved Oxygen Model was performed for the minor basin and canal configuration changes under Major CAMA Permit #128-00. Predicted dissolved oxygen values show very little degradation in the values of dissolved oxygen predicted and remain above the 5.Omg/L threshold.
