The proposed impact include wetland fill in Section 404 wetlands to construct a single family residence and driveway. The proposed impacts area associated with a driveway to access an upland area located on parcel B which is out of the flood zone. As described in the attached PCN Form several alternatives were explored to reduce wetland impacts as well as minimize impacts in the Special Environmental District (SED -1) for Dare County Planning. Below are the results of the two alternatives that were reviewed. Alternative #1 • Section 404 Wetland Impacts= 1,576 square feet • Dare Counties SED -1 = 13,841 square feet Alternative #2 • Section 404 Wetland impacts = 1,356 square feet • Dare Counties SED -1 = 8,100 square feet As a result of the above review alternative #2 was chosen. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The wetland crossings are located at the narrowest portion of the wetlands that will provide access to the upland area. In accordance with Dare County Ordinance Section 22-27.3 (e) (1) Special Environmental District (SED -1) standards state that trees shall not be removed except as necessary for construction (see attached ordinances).The upland area located on Parcel A directly adjacant to Flowers Ridge Road was previously cleared for a septic system installation and future house construction. The proposed driveway will provide access for both parcels and utilize an area that has already been cleared. Having one driveway for both parcels will reduce impacts in the SED -1 zonning. In addition two alternatives were evaluated. Alternative 1 driveway would go through parcel b and impact 1,576 sf of wetlands. Alternative 2 would impact 1,356 sf of wetlands. In addition, building in flood zone X will not require flood insurance which will both save a significant amount of money as well as provide safer location for the residence during storm events. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Minimum Dare County driveway standards were used to provide access to the upland area which reduced the impacts. Culverts will be installed to provide connectivity of the existing wetlands. The driveway constrction in alternative 2 will have less impacts in the wetlands and SED -1 zonning district. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. The specifications and standards of the SED -1 Zoning District are established in order to protect public health and welfare, to preserve the quality of the fresh water supply aquifer which lies beneath the Buxton Woods Forest, to provide an environmentally compatible setting for low density residential housing, and to preserve the economic, aesthetic, and unique and irreplaceable natural resource assets of the land, vegetation, surface waters, and underground waters of this district. (b) Permitted uses. The following uses shall be permitted by right: (1) Detached single-family residential structures. (2) Duplex (2 family) structures. (3) Customary accessory buildings. (4) Publicly owned nature preserves or parks. (5) County owned or leased facilities. (6) Publicly and/or privately owned water distribution systems and all associated underground fixtures including production wells. (8-19-91) (7) Mobile homes located on individual parcels or lots provided the mobile home meets the wind zone III standards (constructed after July 13, 1994) as defined in Chapter 156of the Dare County Code of Ordinances. Existing natural wetlands, ponds, and wetland swales shall not be dredged, filled or otherwise altered from their natural state. No structure, paved area, or any part of a ground absorption wastewater treatment system shall be located within 50 feet of any marsh, stream, pond, or wetland. Minor road crossing fill for property access shall be allowed only as authorized under the jurisdiction of the Army Corps of Engineers specifications for access roads. a.
