Ross Jr., Secretary October 10, 2008 Steve Holland Shelter Creek Quarry, LLC 8315 NC Highway 53 East Burgaw, NC 28425 Dear Mr. Holland: The Division of Coastal Management (DCM) received a copy of a US Army Corps of Engineers Public Notice (Corps Action ID# 2008-01902). Based on the description of the proposed project contained in the Corps' Public Notice, the project appears to require consistency review from the Division of Coastal Management (DCM) before the project may be implemented. However, please note that consistency review would not be the appropriate form of approval from DCM if any portion of your proposed project occurs within an Area of Environmental Concern (AEC) and qualifies as development. In that circumstance, pursuant to Section § 113A-118 of the Coastal Area Management Act, a CAMA permit would be required before you could initiate your project. Attached to this letter is a brochure that provides guidance on complying with the consistency certification process. Additionally, please visit DCM's the consistency webpage located at: http://www.nccoastalmanagement.net/Pennits/consist.htm. Since this letter and attached brochure are a synopsis of the consistency process you may have numerous questions.
