The Division of Water Quality (DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for aetivities,that impact Waters of the U.S., maluding wetlands It is our understanding that the project as presented will result in impacts to jurisdictional wetlands, streams, and other surface waters The DWQ offers the following commitnts based on review of the aforementioned document- Project Specific Conlmeftt' The 404/401 Water Quality Certification application package for this plmoject has been received by the NCDWQ Transportatton Pernutlang Unit The isSuatiee of the FONSI was the last remaining piece of documentation required before the 401 application package could be reviewed and issued. In determining the issuance of the 401 Water Quality Certification, NCDWQ will consider any comments from the US Corps of Engineers Public Notice penod, as well as any comments from this FONSI document received by NCDWQ by September 12.2008_ The NCDWQ appreciates the opportunity to provide corruncnts on this project.
