under the provisions of the National Enviionmental Policy Act According to G S 113A-10, when a
state agency is required to prepare an environmental document under the provisions of federal law, the
environmental document meets the provisions of the State Environmental Policy Act Attached to this
letter for your consideration are the comments made by agencies in the course of this review

This ogee has reviewed the referenced document dated received August 8, 2009. The Division of Water
Quality (DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for
aetivities,that impact Waters of the U.S., maluding wetlands It is our understanding that the project as
presented will result in impacts to jurisdictional wetlands, streams, and other surface waters The DWQ
offers the following commitnts based on review of the aforementioned document-

The 404/401 Water Quality Certification application package for this plmoject has been received by
the NCDWQ Transportatton Pernutlang Unit The isSuatiee of the FONSI was the last remaining
piece of documentation required before the 401 application package could be reviewed and issued.
In determining the issuance of the 401 Water Quality Certification, NCDWQ will consider any
comments from the US Corps of Engineers Public Notice penod, as well as any comments from this
FONSI document received by NCDWQ by September 12.2008_

Dear Ms McMillian
As requested by the North Carolina State Clearinghouse, the North Carolina Department of
Crone Control and Public Safety Division of Emergency Management Geospatial and
Technology Management Office (GTMO) reviewed the proposed project listed above and has
provided comments herein It is our understanding that the North Carolina Turnpike
Authority is proposing to extend the Triangle Parkway from I-40 in Durham County to I-540
in Wake County
The GTMO has the following comments
1) As shown on the Wake and Durham County DFIRM Panels 0737, 0738, 0746, 0747,
0748, 0749, 0756, 0757, 0758, and 0759, the proposed alignment intersects the special
flood hazard area, floodway, non-encroachment area and un-numbered A zones of
numerous streams Any proposed construction within any non-encroachment area or
floodway will require, prior to construction, approval of either a no-rise study with a
no-nse certification for protects that do not increase base flood elevation or for
projects that result in an increase in base flood elevations the approval of a
Conditional Letter of Map Revision
2) The North Carolina Floodplain Mapping Program and North Carolina Department of
Transportation (NCDOT) have entered into a Memorandum of Agreement that
