The purpose of this correspondence is to respond to your letter dated November 13, 2006 regarding the
R-210 Settlement Agreement DWQ staff has reviewed the spill kit items and the list of first responders
to receive the spill kits, maps, and sluice gate keys We feel that the spill kit items are adequate and that
the list of first responders receiving the kits is appropriate Please consider this letter to be written
approval of the items to be obtained by the North Carolina Department of Transportation and distributed
to the first responders in accordance with the R-210, Vass Bypass, Settlement Agreement and
Withdrawal of Petition, 05 EHR 0479, Attachment A, signed October 20, 2006 Should you have any

Subject Sandhills Area Land Trust Mitigation Site for the Vass Bypass in Moore and Lee Counties, TIP Project

Dear Mr Rosser
The purpose of this letter is to inform you of the Division of Water Quality's decision regarding the Sandhills
Area Land Trust (SALT) mitigation site On September 21, 2006, the NC Department of Transportation (NC
DOT) requested that the Division of Water Quality (DWQ) give further consideration to allowing the SALT
mitigation site to satisfy DWQ's restoration mitigation requirements After reviewing all of the information,
DWQ maintains its original position As stated in our November 30, 2005 letter, NC DOT is required to provide
36 8 acres of wetland restoration mitigation credit Based on mapping and hydrologic monitoring, DWQ has
determined that the SALT mitigation site provides only 19 5 acres of wetland restoration credit Therefore, in
accordance with the 401 Water Quality Certification, NC DOT must obtain the remaining 17 3 acres of
restoration credits through EEP Per existing agreements and protocols, DWQ will accept available mitigation
credits from an adjacent cataloging unit However, credits from adjacent cataloging units will be subject to
DWQ's June 21, 2005 guidance on compensatory mitigation in adjacent cataloging units If you have any
