REQUEST FOR MORE INFORMATION
Dear W.O. Baker, Jr. and Josiah D. Baker:
On September 15, 2008, the Division of Water Quality (DWQ) received your application dated
September 11, 2008 to impact 22,669 square feet (ft) of Zone 1 protected riparian buffers and 4,569
square feet (ft) of Zone 2 protected riparian buffers to construct the proposed subdivision and excavated
canal. The DWQ has determined that your application was incomplete and/or provided inaccurate
information as discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless
we receive the additional information requested below, we will place this project on hold as incomplete
until we receive this additional information. If we do not receive the requested information, your project
will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. Planting Plan
Please provide a detailed planting plan that outlines specific species of plants and illustrates the
location of the particular species within the protected riparian buffer.
2. Level Spreaders
The level spreader on the northern portion of the property is located perpendicular to the present
contour lines. Please redesign this level spreader. Also, provide applicable level spreader
worksheet/supplement forms and operation and maintenance (O&M) agreements for both proposed
level spreaders. The worksheets/supplement forms/ and sample O&M agreements can be
downloaded from the following website:
3. Picnic Area in the Buffer
The proposed picnic area in the protected riparian buffer is a prohibited activity in the Tar-Pamlico
Buffer Rules (15A NCAC 213.0259). Please submit a major variance for this proposed impact.olhe

4. Avoidance and Minimization
Please revise your plans to show the boardwalk outside of Zone 1 of the protected riparian buffers.
Also provide the elevation for the entire boardwalk on the revised plans.
5. Septic Fields
Please revise your plan sheets to show the location of the septic fields on all of the proposed lots
showing that additional buffer impacts will not be required.
Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this
information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office. If you will not be
able to provide the requested information within that timeframe, please provide written confirmation that
you intend to provide the requested information, and include a specific timetable delineating when the
requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that
you no longer want to pursue this project and we will consider the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Mr. Ian McMillan or Ms. Amy Chapman at 919-733-
