Size and Location of Property (include waterbody, highway name/number, town, etc.) The project area is located on the east side of
Linville Road, approximately 0.2 mile north of its crossing of the Haw River, in Oak Ridge, Guilford County, North Carolina.
Description of Unauthorized Activity: Please reference the Nationwide Permit 29 verified for use on 4/7/2016. This letter is the
result of a visit to your property on 5/25/2017 where the extent of the permit non-compliance in streams and wetlands was
determined. The unauthorized activities located on your property include the following:
1) Discharge of fill material in approximately 25 linear feet of stream channel (Stream SB) and up to 0.1 acre of riparian
no-riverine wetlands (Wetland WB 1-10/WBA 1-9) upstream of Crossing 2 (see permitted plans) resulting from
above grade rip rap placement outside of the permitted fill boundary;
2) Discharge of fill material in approximately 50 linear feet of stream channel (Stream SB) and up to 0.05 acre of
riparian non-riverine wetlands (Wetland WB 1-10/WBA 1-9), downstream of Crossing 2 (see permitted plans)
resulting from rip rap placement outside of the permitted fill boundary;

Unless you have a Department of the Army permit for the above- described activity, it is a violation of federal law as specified above. You
have agreed to do no further work in waters or wetlands without the required Department of the Army permit. Any further unauthorized
work in waters or wetlands will be considered an intentional violation of federal law.
If you do no further work m waters or wetlands, and perform the remedial action requested below, the Corps of Engineers will take no
further action in this matter. If you continue to work in waters and wetlands without the required authorization, and/or fail to perform the
requested remedial action, the Corps will take further administrative action, and may request the U.S. Attorney to file suit against you. If
you need further information about the Corps of Engineers regulatory program, please contact me at (910) 251-4469.
Remedial Action Requested:
Within 30 days of the date of this correspondence, propose a plan for Corps approval to remove the unauthorized rip rap pad
upstream and downstream of Crossing 2 and restoring original grade and contour. This plan should propose actions necessary
to provide for continued stability of this channel while maintaining aquatic function; such actions include controlling
headeutting/instability upstream of the culvert inlet using natural channel design principles (i.e. cross vane, step downs, etc.)
and planting of appropriate wetland/riparian vegetation. Following review/modification of this plan by the Corps, this work
must be complete within 30 days of Corps approval.
Note that coordination with North Carolina Division of Water Resources (NCDWR) is strongly recommended due to potential
overlap of jurisdiction and other work theV may require within wetland and stream boundaries.
You also have the option to apply for an after -the -fact permit. Please be aware that, through the permittiug process you are
required to demonstrate purpose and need of the project, avoid and minimize your impacts to Waters of the US to the
maximum extent practicable, and provide compensato•v mitigation for anV lost function of the aquatic resources. The Corps
authorized 128 linear feet ofpermanent loss ofstream bed for this project, as such, the project is currently over the compensatory
nzitigatton threshold of 150 linear feet when considering the non-compliant above -grade rip rap pad. Keep in mind that you will
be required to remove all discharged fill and provide restoration to the satisfaction of this office (see items above) for those
