We also request that if for some reason DOT cannot use Design Standards in Sensitive Watersheds, that a note be placed in the
NPDES records to that effect that briefly explains why the Standards could not be met. Thanks.

I checked with our Biologists and we have decided to waive the trout moratorium for this project. We would appreciate
continuing the use of Design Standards in Sensitive Watersheds to protect the listed species in the South Fork New River, which
includes the hellbender that is being investigated for possible listing as federal Threatened or Endangered.

Subject: Watauga Bridge #149 moratorium

Marla,
I just spoke with one of our consultants and they have explained some right-of-way complications with an adjacent property
owner. Apparently the fellow owns a rafting business and he is concerned that the summertime detour will impact his
business. The bridge crosses near the end of Grassy Creek where it dumps into the South Fork New River. We usually don't see
trout moratoriums on the South Fork. As such, and considering the above, is it possible to waive the moratorium here? If not, is
it possible to end the moratorium on March 15Y? That way we could start 6 weeks sooner and minimize summertime work that
may impact the rafters. Please reply all so everyone is in the loop. Thanks.
