Dear Mr. Mull:
On June 22, 2017, the Division of Water Resources (Division) received your application dated
June 19, 2017, requesting a 401 Water Quality Certification from the Division for the subject
property. The Division has determined that your application is incomplete and cannot be
processed. The application is on -hold until the following information is received:
1. Please provide more details regarding avoidance and minimization of stream impacts.

As we discussed during the site visit Jane 13, 2017, the Division believes that there
are practical alternatives to your proposed project. There is suitable access to the
back of the building on the southern side of the church that would not require a
stream crossing. There is a footbridge that allows safe passage to the playground. In
addition, the Division believes that there are alternatives to better enhancing the
landscapeand stabilizing the stream by resloping the right bank descending and
planting native vegetation on both banks. Please revise the plans to avoid the impacts
or provide a detailed explanation of why this plan for the activity cannot be
practically accomplished, reduced or reconfigured to avoid impacts to the trout
stream.
2. A land disturbing activity in the buffer zone of a trout stream can be permitted if the
disturbance is temporary and the extent is minimal. Permission must be received from
the Division of Energy, Mineral, and Land Resources (DEMLR). Please contact Stan

Pursuant to Title 15A NCAC 02H.0502 (c), the applicant shall famish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received within 30 calendar days, of receipt of this email, the Division will be unable to
approve the application and it will be returned. The return of this project will necessitate
reapplication to the Division for approval, including a complete application package and the
appropriate fee.
