PROJECT SUMMARY: The applicant is proposing to reconfigure the existing docking facility for a total of nine (9) slips, replace the existing boat ramp, install rip rap (including supplemental vinyl sheeting) and construct a kayak launch at the Middle Island POA dock and boat ramp. PROJECT DESCRIPTION To find the project site from the Bald Head Island Ferry Landing travel southwest on Keelson Row and veer left onto N. Bald Head Wynd for 1.4 miles. Continue onto Federal Road and turn left onto SE Beach Drive. Travel approximately 0.6 miles and turn left on Cape Creek Road. Follow Cape Creek Road to the gate, which will be locked. The docking facility is located at the end of Cape Creek Road. Contact Mr. Alan Reyner for access. He can be reached at 803-609-3417. The project site is bordered by Cape Creek to the north and undeveloped Bald Head Conservancy Owned marshland to the west, east and south. Bald Head Island is part of an island group known as Smith Island, located at the confluence of the Cape Fear River and Atlantic Ocean between Fort Fisher and Oak Island/Caswell Beach in Brunswick County. The island is accessed by private boat or a private ferry service from Southport. This project area is located at the End of Cape Creek Road in the northern central part of the island and encompasses approximately 0.93 acres and averages approximately 8 ft. above normal high water (NHW). Vegetation that exists on the property adjacent to the docking facility and boat ramp consists primarily of native grasses, Wax Myrtles and Oak trees which transitions into Salt Meadow Grass (Spartina patens). A storage house and gravel parking area are the only man-made uses on the high ground portion of the tract. The adjacent Bald Head Island Conservancy property allows access to the Middle Island POA docking facility and boat ramp via an old wooden bridge spanning coastal wetlands, which is a tidal slough of Cape Creek. The applicant's measured shoreline is approximately 262 ft. in length, including a 12 ft. wide concrete boat ramp. The high ground area immediately adjacent to the docking facility is stabilized by rip rap measuring approximately 133 ft. long by 20 ft. wide (2660 sq. ft.). There is a band of coastal wetlands along the top edge of the existing rip rap consisting primarily of Salt Meadow Grass (Spartina patens). The remaining unstabilized shoreline is dominated primarily with Salt Marsh Cordgrass (Spartina alterniflora). The existing docking facility and boat ramp are for the sole use of the Middle Island POA residents. According to the narrative, the Docking facility has been utilized by Middle Island Residents for over 35 years on a tract that is restricted for Conservation and Recreational Purposes only. The current L- shaped docking facility has been utilized for approximately 8 boat slips along the floating dock spines without any specific designated slip areas. The existing pier, which measures 22 ft. in length by 8 ft. in width, and two floating docks, measuring 42 ft. in length by 5 ft. in width and 78 ft. in length by 5 ft. in width, extend approximately 67 ft. (approximately 1/3 of the width of the Waterbody) into Cape Creek. Cape Creek is approximately 209 ft. across in this area. The existing 48 ft. long by 12 ft. wide boat ramp is constructed of 4 ft. wide concrete sections with associated rip rap adjacent to the ramp (see Narrative, Sheet 3 of 5 and Supplemental Drawing SD -1). The project area is located within the Estuarine Shoreline, Estuarine Water and Public Trust Areas of Environmental Concern (AECs). General Permit No. 63216D was issued to Middle Island Marina Co. on March 31, 2014 to replace the existing boat ramp and construct two associated rip rap groins. The boat ramp was permitted to extend no more than 20 ft. below Normal High Water (NHW) and the rip rap groin was limited to 25 ft. below NHW with a maximum width of 10 ft. directly adjacent to the boat ramp. Middle Island Dock and Boat Ramp Page Three The Village of Bald Head Island Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Low Density Residential. The waters of the Atlantic Ocean contiguous with this portion of the Cape Fear River are classified as SA/HQW by the North Carolina Division of Water Resources. The waters are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to reconfigure the existing docking facility for a total of nine (9) slips, replace the existing boat ramp, install rip rap (including supplemental vinyl sheeting) and construct a kayak launch at the Middle Island POA dock and boat ramp. The applicant is requesting to reconfigure the layout, creating 9 formalized boatslips, by constructing a new docking facility approximately 20 ft. closer to the shoreline. The new configuration would extend approximately 45 ft. into Cape Creek, which is less than'/4 width of the waterbody. Two new floating docks, one measuring 108 ft. in length by 5 ft. in width running parallel with the shoreline and one measuring 34 ft. in length by 5 ft. in width running perpendicular to the shoreline, would extend waterward from the existing 22 ft. long by 8 ft. wide fixed dock creating an L shape. The new configuration would also include construction of 4 finger piers, two measuring 24 ft. in length by 4 ft. in width, and two measuring 22 ft. in length by 4 ft. in width, each extending waterward into Cape Creek from the new 540 sq. ft. floating dock. A 5 ft. long by 5 ft. wide kayak launch has been proposed on the landward side of the new floating dock in water depths measuring approximately -3.5 ft. at NLW. The application states that the proposed new docking configuration would provide docking space for up to nine (9) vessels within existing water depths ranging from — 3.5 ft. to -8.0 ft. at normal low water. (NLW) (see Sheets 3 and 4 of 5). The applicant is also proposing two 48 ft. long by 5 ft. wide rip rap groins (480 sq. ft.), one on each side of the existing boat ramp, extending the entire length of the existing boat ramp, which extends 10 ft. above Normal High Water (NHW). Vinyl sheeting is also proposed, with a 10 inch offset from the ramp, not to extend more than 10 ft. above NHW in order to stabilize the existing boat ramp and prevent scour for a total length of 48 linear ft. on each side of the boat ramp (see Sheet 3 of 5). Gravel (456 sq. ft.) is proposed beneath the boat ramp area for stabilization within the existing 48 ft. long by 12 ft. wide footprint. The applicant states that the existing 48 ft. long by 12 ft. wide concrete boat ramp may need to be replaced in 4 ft. wide concrete sections. All concrete would be poured on the high ground and brought in via barge to be placed in the existing footprint. All work is proposed to be conducted via barge from Cape Creek. 10. ANTICIPATED IMPACTS: The proposed structures would incorporate approximately 1939 sq. ft. of Estuarine Waters and Pubic Trust Area, of which 861 sq. ft. is already impacted by the existing boat ramp and rip rap. The proposed structure would extend approximately 45 ft. into Cape Creek, which measures approximately 209 ft. across in this area. The structures would be located in water depths of -3.5 ft. to -8 ft. at NLW and would conform to the 1/4 width rule. The proposed structures would not encroach into either adjacent 15' Riparian Corridor Setback Area. Minor increases in turbidity should be expected during construction. Submitted by: Tara MacPherson Date: July 17, 2017 Office: Wilmington NARRATIVE FOR MIDDLE ISLAND DOCKS AND BOAT LAUNCH For over 35 years a .93 acre tract of Land on the western portion of Middle Island has served as a Dock and Boat launch ramp for Middle Island Residents. It is on Cape Creek approximately 1.5 miles from the federally maintained Cape Fear River. The .93 acre tract is owned by the Middle Island Property Owners Association, Inc. and is surrounded by a 21.33 acre Sanctuary owned by Bald Head Island Conservancy, Inc. The.93 acre Tract owned by the Association is restricted for Conservation and Recreational purposes. Residences are prohibited. No development is allowed on the Conservancy property. The docks and the boat launch ramp have not been replaced since they were installed around 1981. Due to the extended time period and various storms over the years the docks and boat launch ramp need to be replaced. Some flotation is missing from the existing docks and much of it is believed to be water logged. The construction of the docks will be typical dock construction using treated lumber. The attached drawings reveal a more functional and practical layout and allow for a total of 9 slips. It also has the advantage of providing that because of reconfiguring the docks and docking "Bow or Stern In" as opposed to "Beam To" any boats that use the facility will be approximately 20 feet closer to the shoreline as the proposed Project will not encroach as far into Cape Creek as the existing docks. We estimate that the proposed Project will extend approximately 20% into Cape Creek. There is no development (only marsh) or land access across from the docks on the other side of Cape Creek. The Project is located approximately 75' on one side and 150' on the other side from the Conservancy property and the Conservancy's Riparian Access. The Boat Launch Ramp (12 4' wide concrete sections) has separated in several places and although useable at high tide is in need of repair and fastening together. It is anticipated it can be repaired but may need some additional riprap or even vinyl groins on either side running a maximum of 48' each for stabilization and scour protection. The riprap would be 5' wide on either side of boat ramp and would not extend beyond IG` above NHW. If vinyl sheeting is used it would be %Z" wide with a 10" offset and would not extend more than 1Nbove NHW. In the alternative if the ramp can't be easily stabilized we may wish to remove it and replace it with similar concrete sections or even marine lumber. It is anticipated all work for the Docks and the Boat Ramp Launch will be done from the water by Barge. To date no work has been done on this Project. We also request permission to cleat off a Kayak launcher per the attached drawing.
