This permit, issued on September 17. 2008 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Marina 1) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed in an easily accessible location. The pumpout shall be operable and maintained for the life of the authorized marina. 2) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on-site with a representative of the Division of Coastal Management to ensure that the required pumpout facility is in place and operable. 3) The marina shall display a sign showing the location of the on-site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main piers. (See attached sheets for Additional Conditions) r ms permit action may tie appealea oy the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Port Cape Fear Associates Permit # 128-98 Page 2 of 5 ADDITIONAL CONDITIONS 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) Unless specifically altered herein, this permit authorizes only the removal, reconfiguration, and construction of the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina facility without permit modification. No non- water dependent uses of structures may be conducted on, in or over public trust waters without permit modification 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 8) This permit does not authorize.the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may' be caused from existing or future operations undertaken-by the United States in the public interest. 9) This permit authorizes the addition of a maximum of 137 formalized boat slips. Excavation 10) An earthen plug will be left between the existing basin and the expanded until all excavation activities landward of the plug has been completed. In order to prevent sedimentation in adjacent waters, 24 hours will be allowed to elapse before the plug is removed. 11) Excavation shall not exceed -8' feet below mean low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 12) No coastal wetlands shall be excavated or filled, even temporarily. 13) The temporary placement or doubling handling of excavated materials within waters or wetlands is not authorized. 14) Unless altered herein, the area of excavation shall not exceed the limits indicated on the attached workplan drawing. Spoil Disposal 15) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the beginning of any excavation activities. Port Cape Fear Associates ADDITIONAL CONDITIONS Permit # 128-98 Page 3 of 5 16) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. Shoreline Stabilization 17) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings. 18) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 19) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. 20) All backfill material shall be clean and free of any pollutants except in trace quantities. 21) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 22) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. Boat Ramp 23) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. Upland Development 24) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including but not limited to the construction of the dry stack facility and parking spaces associated with the above referenced property, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. NOTE: The permittee will be required to apply for a driveway permit from the Department of Transportation. Sedimentation and Erosion Control 25) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Port Cape Fear Associates ADDITIONAL CONDITIONS Permit # 128-98 Page 4 of 5 26) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.) At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Department of Environment and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Stormwater Management 2'/) The Division of Water Quality approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW8 930917, which was issued on 5/14/08. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Mitigation 28) In accordance with requirements of the US Army Corps of Engineers, and in order to compensate for impacts to .476-acres of wetlands, the permittee shall make payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by the NC EEP, sufficient to perform the restoration of 1.0-acres of riparian wetlands in the Tar-Pamlico River Basin, Cataloging Unit 03030005. 29) Construction within jurisdictional areas on the property shall begin only after the permittee has made full payment to the NC EEP and provided a copy of the payment documentation to the Corps of Engineers and DCM, and the NC EEP has provided written confirmation to the Corps of Engineers and DCM that it agrees to accept responsibility for the mitigation work required, in compliance with the MOU between the North Carolina Department of Environment and Natural Resources and the United States Army Corps of Engineers, Wilmington District, dated November 4, 1998. General 30) The authorized covered dock office shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the side along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 31) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 32) The roof of the covered dock office shall not be designed for second story use. Port Cape Fear Associates Permit # 128-98 Page 5 of 5 ADDITIONAL CONDITIONS 33) This permit shall not be not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 34) This Major Modification shall be attached to the original Permit No. 128-98, which was issued on 9/30/98, and as well as all subsequent modifications, refinements and renewals, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 35) All conditions/stipulations remain in force under the Major Modification, unless specifically altered herein. 36) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-today operation of the facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water Quality Certification No. 3642 (DWQ Project No. 05-0239v2), which was issued on 8/1/08.
