JAY ZIMMERMAN Director DWR # 17-0809 CURRITUCK County On June 29, 2017, the Division of Water Resources (Division) received your application dated June 27, 2017, requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Avoidance and Minimization: Please provide more details regarding avoidance and minimization of 0.11 acres of coastal wetland impacts for this project. [15A NCAC 02H .0506(f) and (g)] • This Office believes that the proposed impacts to coastal wetlands on the plans as described can be moved or reconfigured to minimize the impacts. Please revise the plans to minimize the impacts or provide a detailed explanation of why this plan for replacement of the remnant bulkhead utilizing the historic alignment cannot be practically accomplished, reduced or reconfigured to better minimize disturbance to the coastal wetlands. As part of the narrative, please conduct an alternative analysis addressing why this is the preferred methodology compared to other shoreline stabilization methods such as breakwater or low profile bulkhead that would be graded to the existing wetland elevation as discussed during the October 16, 2016 onsite multi -agency meeting. Pursuant to 15A NCAC 02H .0506(f) and (g), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
