9. PROJECT DESCRIPTION:
The project site is located at 2000 Chair Road, in Castle Hayne adjacent to the Northeast Cape Fear River
(NECFR) in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel
south on Market Street for approximately 0.4 miles until you come to the intersection of Eastwood Road and
Martin Luther King, Jr. Parkway (MLK). Merge right onto MLK and continue to travel west approximately 3.5
miles towards Downtown Wilmington. Merge right onto the off -ramp towards Castle Hayne Road (NC Highway
133) and travel north approximately 3.7 miles until you reach Chair Road, which will be located just south of 1-
140 (Wilmington Bypass). Turn left onto Chair Road and travel west approximately 1.75 miles until you reach
the property of interest.
The project site is located at the end of Chair Road adjacent to the NECFR, and is comprised of thirteen individual
tax parcels totaling an approximately 258 acre tract owned by River Bluffs Development Corporation (applicant)
and Chair Road, LLC. The project site has approximately 3,397 linear feet (LF) of shoreline frontage along the
NECFR and has elevations ranging from 0 feet to 40 feet above normal high water (NHW). The highground
transitions abruptly to the shoreline and appears to be currently experiencing significant erosion, especially along
the northern end of the project site. The shoreline along the majority of the project site is not easily accessible
from the highground due to the existing elevations.
Existing structures on the project site include access roads, single and multifamily homes, a pool, a portion of
the previously authorized marina that is under construction, and a boat ramp and fixed walkway with a gazebo
that is under construction. There are existing overhead power lines that are located on the central portion of the
project site, which cross the NECFR within a CP&L easement. There is also a small cemetery that has been
identified and demarcated in the southern portion of the site. The adjacent riparian property to the north is a
facility owned and developed by General Electric and 1-140 is located to the east of the project site. The property
to the south is currently residential.
The project site has highground vegetation consisting primarily of domestic grasses and native trees including:
Bald Cypress, Magnolias, Dogwoods, Pines and Oaks. The highground slopes gradually to the edge of wetlands
along the northern and southern end of the property shoreline, which consist primarily of mature Bald Cypress
and Coastal Wetland plants including: Giant Cord Grass (Spartina cynosuroides), Cattails (Typha spp.), Bullrush
(Scirpus spp.) and Sawgrass (Cladium jamaicense). The existing Coastal Wetlands vegetation in the southern
shoreline of the project site is a dense expanse, which extends approximately 900 feet from the shoreline to the
east within the interior portion of the site within a tributary known as Rock Spring Branch. A Jurisdictional
Determination (JD) was approved by the US Army Corps of Engineers (USACE) for the existing Section 404
Wetlands, which are located on the project site (SAW -2009-01231, SAW -2008-00068 and SAW -2002-00617).
In 2013, CAMA Major Permit 30-13 was issued to River Bluffs Devleopment Corp. for a planned unit
development on the subject property including an associated marina, boat ramp, walkway along the shoreline
and shoreline stabilization. Several minor modifications have been made to the permit and it is due to expire
12/31/18. Due to an oversight a portion of the currently proposed modifications were constructed prior to
receiving authorization. This Major Modification includes those changes and is part of the restoration agreement
issued from this office on May 25, 2017 as part of Notice of Violation #17-11 D.
The Wilmington -New Hanover County LUP classifies the upland areas of the project site as Wetland Resource
Protection and the open water as Conservation. The waters of the NECFR are classified as SC, Sw by the NC
Division of Water Resources (DWR). The NC Division of Marine Fisheries (DMF) has designated this area of
the NECFR as Primary Nursery Area and the waters are closed to the harvesting of shellfish. The USACE
federally maintained navigation channel is located approximately 250-300 waterward of the NHW level. The
width of the river in the project location ranges from approximately 650 to 700 feet across the river.

PROPOSED PROJECT:
River Bluffs Development Corporation is proposing to reconfigure and expand a community marina within the
Northeast Cape Fear River. The application states that 625' of the authorized fixed walkway was constructed
as of February 2017 beginning at the northernmost end of the shoreline. The applicant proposes to change the
remaining 1,055' of walkway to 10' wide and floating in the same general footprint of the previously authorized
elevated, fixed 8' wide walkway (See Sheet 1 of 12 and 4 of 12). The proposed floating walkway would provide
side -to dockage for 42 vessels in water ranging in depth from -7' to -10' at MLW. The application states that the
total slip count for the entire facility would be 188.
At the northernmost water access, the concrete boat ramp would be extended from 67' to 91' in length, with
gravel on the northern side measuring 53' in length and varying in width from 1' to 5', and gravel on the southern
side of the ramp measuring 5' in width by 34' in length (See Sheet 2 of 12). Adjacent to the boat ramp, along the
southern side, would be brick -lined steps measuring 32.5' by 8.5' leading to a 6' by 8' section of wooden walkway
which would then connect to the existing wooden walkway, (See Sheet 2 of 12). A floating kayak dock located
south of the existing boat ramp would contain four sections one measuring 8' in width by 32' in length, one 7' in
width by 11' in length, and two 4' in width by 13' in length sections. The 8' by 32' section would extend in a
westerly direction, perpendicular to the fixed walkway. The kayak launch portion, consisting of an 11' by 7'
platform and two 4' by 13' fingers, would extend in a southerly direction from the 8' by 32' floating section. Along
the ramp leading from the fixed walkway to the kayak launch would be a 34' section of breakwater (See Sheet 3
of 12 Inset 1).
Along the existing fixed walkway, a cantilevered bench measuring 3' by 24.5' would be adjacent to a relocated
gazebo measuring 19.5' by 19.5' just north of the proposed 1,055' by 10' floating walkway (See sheet 3 of 12
Inset 2). South of the proposed floating walkway a second gazebo measuring 16' by 16' would be relocated with
a 6' wide access way and connect to the existing marina. Along the shoreline adjacent to the relocated gazebo,
69' of an existing retaining wall would be removed (See Sheet 3 of 12 Inset 3). A 12' wide deck is proposed on
the upland area adjacent to the southernmost marina access (See Sheet 5 of 12).
The applicant proposes to add floating finger piers between every boat slip, with finger piers varying in length
from 20' to 35' and varying in width from 3' to 5' (See Sheets 5-7 of 12). The applicant also proposes adding 10
floating platform boat lifts in slips 53-56, 29-33 and one floating platform along the main spine south of the C
access pier (See Sheet 5 of 12). The % channel width setback shown on the submitted work plan drawings
appears accurate. As proposed, the marina does not appear to exceed the % width limitation.
The applicant proposes several areas of shoreline stabilization. Along the drive to the boat ramp a 219' retaining
wall varying in height from 2'-10' above grade and running in an east -west direction would stabilize the shoreline
and upland area. At the waterward end of the retaining wall would be a 15' by 12' section of rip rap. Along the
fixed walkway would be 4 sections of living shoreline, each consisting of riprap with backfill and plantings. Living
shoreline area 1 would be 925 square feet in area and would extend a maximum of 25' waterward of NWL (See
Sheet 8 of 12 and 11 of 12). Living shoreline area 2 would be 2,679 square feet and would extend a maximum
of 28' waterward of NWL (See Sheet 8 of 12 and 11 of 12). Living shoreline area 3 would be 2,752 square feet
and would extend a maximum of 24' waterward of NWL (See Sheet 9 of 12 and 12 of 12). Living shoreline 4
would be 4,494 square feet and would extend a maximum of 41' waterward of NWL (See Sheet 10 of 12 and 12
of 12). The combined backfill for all four areas is 3,772 square feet of riprap and 7,097 square feet of sand fill.
None of the proposed living shoreline areas would extend beyond the authorized access walkway.
No changes are proposed to the non -water dependent development previously authorized by State Permit No.
30-13. Due to an oversight a portion of the above proposed modifications were constructed prior to receiving
authorization. This Major Modification includes those changes and is part of the restoration agreement issued
from this office on May 25, 2017 as part of Notice of Violation #17-11 D.

ANTICIPATED IMPACTS:
The proposed modifications to the community marina would incorporate an additional 11,215 sq. ft. of Estuarine
Waters and Public Trust Area. As proposed, the marina does not appear to exceed the % width limitation. As
proposed, the marina configuration would accommodate up to 135 permanent vessels and 53 temporary side -
to dockage for a total of 188 slips as they are numbered on the workplan drawings (See Sheet 5 of 12). However,
there appears to be potential for two vessels to dock on the end of docks 2-10 which would increase the potential
slip count to 197. The application states that the existing water depths in the location of the proposed marina
ranges from -10 feet to -15 feet @ MLW. Due to the linear design and floating pipes, no bottom or shading
impacts are anticipated, aside from the vertical support pilings. The proposed living shorelines would incorporate
approximately 10,850 sq. ft. of Estuarine Shoreline and Public Trust Area.

Revisions to Previously Approved Water Dependent Structures and
Construction of Living Shoreline - Marsh Sill

River Bluffs Development Corporation requests modification of CAMA Permit 30-13 for revisions
to previously approved water -dependent structures and shoreline stabilization. The planned
unit development and its water -dependent structures are partially constructed at the time of
this request. Necessary revisions to approved water -dependent structures became apparent
during construction. The revisions would, in part, provide solutions to these observed
conditions. All changes requested in this modification are limited to the water -dependent
structures and shoreline stabilization. No changes to the upland development are requested.
Water -dependent structures existing at the time of this request include (from north to south):
1. Concrete Boat Ramp (14' x 91') with brick steps (8.5' x 32.5'), gravel along the
northern and southern sides (3'x 53') and (5' x 34'), rip rap stabilization (12'x 15'),
breakwater along southern edge 34 Ift. Retaining wall south of ramp and ramp
approach 219 Ift.
2. Floating Dock at Boat Ramp (8'x 32').
3. Fixed Walkway with Breakwater along northern shoreline, approximately 624 to
625 Ift.
4. Gazebo along fixed walkway (19.5' x 19.5') with cantilevered bench (3'x 24.5').
S. Pilings for currently requested floating walkway/dock, 12 in total.
6. Within Previously Approved Marina Floating dock with debris deflector (6' x 145'),
10' wide floating marina access dock from debris deflector dock to "Dock 5", "Dock
5" with twelve 30' slips and one 68' 6" slip.
7. Marina Access Deck/Gazebo Central access to marina. Deck (12'x 12'), wooden
walkway 54 Ift (19 ft of which is below MHW), gazebo (16' x16').
Currently requested changes include:
1. Revision of Fixed Walkway to Floating Walkway. CAMA Permit 30-13 authorized a
fixed walkway along the River Bluffs shoreline to provide pedestrian access between
the community marina at the southern shoreline and a boat ramp at the northern
shoreline. The authorized fixed pier (boardwalk) was approximately 2,500' in
length, but was shortened with a 2013 minor modification involving changes to the
community marina's layout. During construction of the walkway in the fall/winter

of 2016, installation of the structural pilings became problematic. Pilings were being
jetted into place. However, river currents were so swift that sediment was removed
from the area before settling around the installed piling and threatened the stability
of the pilings. In response to this condition, the method of piling installation was
changed to be pilings driven into place. The type and size of pilings had to be
revised, and given the time and cost of this revision, fewer pilings were installed
along the previously approved piling alignment. The approved fixed walkway is now
proposed to be floating and attached to the driven pilings.
A February 2017 as -built survey shows 625 Ift of fixed walkway, beginning at the
northern end of the shoreline, was constructed before the piling installation was
revised. Approximately 1,055 Ift of walkway remains unconstructed between the
end of the fixed walkway and the marina. This modification requests to change the
previously approved fixed walkway to a 10' wide floating walkway along this 1,055
Ift section (Figures 1 and 4). A 10' width is necessary for stability and safe use.
Given the length of the walkway and use by community members and guests of
varying ages, additional width beyond the more common six foot width is needed
for safety. The waterward edge of the floating dock may be used for dockage for
residents and guests during special events at the community. Across the 1,055 Ift,
approximately 42 slips would be available based on one slip per 25' of length.
Water depths along the waterward edge of the floating dock range between -7'
MLW and -10' MLW.
Similarly, at the very south end of marina there is available waterward side -to
dockage (not within fingers) that totals 266 Ift equaling approximately 11 slips. A
total slip count for the entire waterfront would be:

New Kayak Dock. The addition of a kayak dock is requested at the northern end of
the property's shoreline. The floating kayak dock is proposed just south of the 8'x
32' floating dock along the boat ramp at the northern end of the shoreline (which
exists at the time of this request). The kayak dock would provide one launching slip
and would consist of three floating sections: (1) a Tx 11' dock and (2) two 4' x 13'
docks. The kayak dock will be accessed by the existing ramp/gangway from the
existing fixed walkway, just south of the boat ramp (Figures 1 and 3). Water depths
in the area of the proposed kayak dock are more than -10' MLW.

3. Relocated Marina Access from Clubhouse Area. An approved gazebo located
between the upland clubhouse area and the marina would be slightly relocated.
The gazebo would be moved approximately 44' south of the previously approved
location. The gazebo would remain a 16' x 16' elevated structure (Figures 1 and 3).
Approximately 85' of wooden boardwalk (6' wide) would extend from the gazebo to
the end of the previously approved walkway at the clubhouse.
4. Construction of living Shoreline for Shoreline Stabilization. The River Bluffs
shoreline is a steep bluff along the NE Cape Fear River. The intertidal area at the
base of the bluff is an erosive environment subject to river currents and is largely
unvegetated. Shoreline stabilization in the form of riprap, to be placed underneath
the previously -approved fixed walkway, is currently authorized.
Following Hurricane Matthew, the applicant noted several distinct areas along the
shoreline where storm erosion had resulted in depressional areas. Four such areas
have been identified and are requested with this modification to be stabilized with a
living shoreline. Riprap marsh sills with plantings of Spartina cynosuroides (living
shoreline) would be installed in these four areas. Prior to planting, minor grading
(cut/fill) of the planting areas above the sills will mimic the existing elevations of S.
cynosuroides naturally occupying other portions of the River Bluffs shoreline. Plan
and cross sectional views of the proposed marsh sills are provided in Figures 8-12.
5. Single -loaded marina slips. The slips within the marina were originally double -
loaded with a floating finger dock between every other boat. The design has been
revised to provide for single -loading with floating fingers between every boat. This
revision adds a measure of safety for boats entering and leaving their slips during
rapid river flow conditions, reducing unintentional contact with neighboring boats in
their slips. This design also allows for more convenient boarding by residents and
guests. All floating fingers are either 5' or 3' wide and run the length of the slips
(Figures 6 and 7).
6. Floating dock platforms. The addition of ten floating dock platforms (7' x11.5') to be
located within the marina.
