Dear Mr. Trask:
This correspondence is in reference to your application for Department of the Army (DA)
authorization to permanently place fill material in 1.44 acres of jurisdictional wetlands and 0.53 -
acre (6,521 linear feet) of relatively permanent waters and to temporarily impact 0.22 -acre of
jurisdictional wetlands in order to construct a 255 -lot residential subdivision with associated road
crossings, stormwater features, and lot fill. The 1,164 acre property is located west of Highway
17 and north of Sidbury Road in Scott's Hill, Pender County, North Carolina, and is known as
the Blake Farm Subdivision (34.3347 N, -77.7647 W).
Based on a review of your recent submittal, the following comments and request for
additional information must be addressed in order to complete the evaluation of the project's
compliance with the appropriate regulations and guidance.
1. Please include a discussion in the narrative that addresses the lateral hydrologic effect of
P-11 and the large linear pond located above Wetland E on Wetland F and Wetland E,
respectively. The Corps has previously discussed two options for addressing lateral effect
with the applicant. The applicant may propose to utilize the NRCS Ditch Guide to determine
the lateral effect of these features on wetlands and include the total acres of secondary
impacts in the total project impacts. The applicant may also propose a monitoring plan that
will help determine if lateral effect is occurring and to what extent. If the monitoring
indicates that wetlands are being drained such that total wetland area is reduced, the applicant
may be required to provide additional compensatory mitigation to offset the lost wetland area.
Please also include in the narrative a discussion regarding whether or not Wetland H is
expected to remain viable after construction. If post -project viability of wetland hydrology
cannot be demonstrated, the applicant may choose to include the remainder of Wetland H in

the total impacts and provide mitigation or propose a monitoring plan.
For mitigation proposals that are less than a 2:1 ratio, NC WAM or another approved
functional assessment must be used to aid in justifying the lower ratio.
2. During previous discussions, the Corps addressed the need for all plans (i.e. stormwater,
sediment and erosion control, and construction) to match. The approved stormwater plans
showed three 48" RCPs at the crossing of P-6 and Farmhouse Drive as P-6 discharges into a
Linear Pond; however, the plans provided to the Crops showed only two 48" pipes. Please
clarify which plans are correct. In the event that the stormwater plans are correct, please also
explain the need for three 48" pipes as opposed to two, as well as updated drawings reflecting
the correction.
3. The current plans show that a flashboard riser will be installed in the upper reach of ditch
X-3. Recent discussions revealed that NC DWR approved the installation of the riser to hold
hydrology in the large, off-site wetland. Please provide detailed information about the
purpose, design, and long-term management of this structure and the potential impacts on
wetlands as well as the potential for hydrologic trespass on upstream properties. The
information should include an assessment of the potential risks posed by the structure in light
of its long-term management requirements and the mitigating factors that reduce any
potential risks. Please also submit detailed, fully -dimensioned plan view and cross section
drawings of the proposed structure that are referenced to existing wetland elevations.
4. According to the narrative, the location of the outlet for SCM -4 on the drawing is
incorrect. Please make the appropriate corrections.
5. Please provide separate totals of avoided impacts versus minimized impacts for each
separate wetland impact where appropriate. (i.e. Impacts to Wetland F were reduced by XX
acreage).
6. The amount of mitigation is incorrect on the credit reservation letter. The letter reflects
that 2.80 credits/acres have been secured; however, the required mitigation is 2.90
credits/acres, based on the current information provided to the Corps. Please provide a
corrected credit reservation letter. Also, please note that the mitigation requirements may
change based on the response to this information request.
7. Please correct the page numbers of the Appendices to correctly match the Table of
Contents.
