Dear Mr. Spoon:
On June 11, 2008, the Division of Water Quality (DWQ) received your application dated June
10, 2008, to fill or otherwise impact 0.007 acres of 404/wetland and 313 linear feet of perennial
stream (145 linear feet permanent impact, and 163 linear feet temporary impact), and 101 linear
feet intermittent stream impact to construct the proposed residential development at the site. On
September 5, 2008, the DWQ received additional information from you, however, the DWQ has
determined that your application was incomplete and/or provided inaccurate information as
discussed below.
The July 18, 2008 Request for More Information Letter stated, "Please provide the
Required Items Checklists (second page of the Wet Detention Basin Supplement Forms),
as well as all of the required items." Numerous items on the Required Items Checklist
were omitted from the September 5, 2008 submittal, including:
a. Plans at the entire site at a 1" = 50' scale or larger showing all listed items
including the drainage easements.
b. Partial plans and details of the wet detention pond at a scale of 1" = 30' including
a vegetation specification for the planting shelf.
A section view of the wet detention basin at a scale of 1" = 20' or larger.
For these reasons your permit application is hereby considered returned. Once you have
redesigned your project to address the problems and inadequacies with your application as it was
submitted, you will need to reapply for DWQ approval. This includes submitting a complete
application package with the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clear Water Act for this
activity and any work done within waters of the state would be a violation of North Carolina
