On behalf of our client, the Foster Estates HOA, please find the enclosed Pre -Construction
Notification (PCN) application for the referenced project dated July 6, 2017. The purpose of the project is
to manually and mechanically remove deposited sediment wl-&h was placed in and had migrated along an
approximate 325 linear foot reach of an unnamed tributary to Dix Creek. A NVvP-3 is requested for the
completed work. Please see the attached copy of the PCN application.
Four copies of the PCN application are being provided to the North Carolina Department of
Environmental Quality, Division of Water Resources with a check for $570 to cover the 401 WQC
written approval fee. A copy is also being provided to the USFWS. McGill Associates, P.A. is the
Authorized Agent (forin included) and should be copied on all project correspondence. Please let us

3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The prooect site is an aivroximately 325 linear foot section in an unnamed tributary to Dix Creek. The northern stream
bank area is a mix of heavily wooded and cleared voperty, while the southern stream bank area is cleared maintained
land currently used as a common area for the Foster Estates sub -division.

3d. Explain the purpose of the proposed project:
The purpose of the proposed prooect was to manually and mechanically remove deposited sediment which was placed in
and has migrated along an awroximately 325 linear foot reach of an unnamed tributary to Dix Creek.
3e. Describe the overall project in detail, including the type of equipment to be used:
Silty dredge sr)oils od-ginatina from a recently dredaed pond by Foster Estates HOA was placed on the banks and within
UT -Dix Creek. Impacts (SI) consisted of approximately 325 If. of temporary fill material. In response to NOV-2017-PC-
0351 Foster Estates hired a subcontractor to remove the sediments from the impacted portions to UT -Dix Creek. Impacts
to LIT -Dix Creek were evaluated on 6/14/2017, and results from the investiaation determined that hiahly mobile, silty
sediments have miarated downstream aivroximately 325 linear feet (if), demsitinci in bar formations, behind rocks, and
within pools. Focus of the sediment remediation was to remove all of the deposited material that is still in its ori-ginal
location, as well as miarated sediment within the 325 If. portion that is thicker than 1-2 inches.
The sediment removal operation began and was completed on June 19, 2017. The sediment removal overation moved
from upstream beoinninQ lust above the 90 LF dredge spoils placement area to must below the picnic area downstream.
Sediment removal activities were conducted in the dry, to the maximum extent practicable, through the use of a sand ba -q
dam and pump around operation limiting flow volume durina work. This mitigated further downstream migration
sediment, enhanced visibility of the stream bed, and increased the amount of sediment removed. Typical hand tools
(shovels and rakes) and five -gallon buckets were utilized by the bucket crew for sediment removal. Sediment was then
deposited in an all -terrain vehicle sta-ged on the bank to transport removed sediments to the disposal area. A small
excavator was used to remove the dredoe spoils that were directly deposited in the stream bed. The hiaher volume of this
material made it necessary for the use of eauipment. Special care was taken to ensure that excavated material was
limited to dred-ge spoils and minimal natural substrate was disturbed. This spoils material was then deposited in a flatbed
dump truck staaed on the bank to be transported to the disi)osal area.
The right bank along the 90 LF of dredge sediment placement was previously eroded and nearly vertical, During the
sediment removal process, it was shaped to allow for Pror)er installation of coir mattina. The coir mattina (0.75" xO.75" 460
-q/m weight) was installed with wooden stakes and over seeded with a riparian mix. The disturbed areas above the stream
bank and other stream bank areas with limited impacts due to foot traffic were seeded and mulched with straw to allow for
reve-getation.
Once removal operations were complete and the sediment had been Oaced in the existing sr)oils area, the material was
smoothed with a small excavator to allow for complete dewatering. Once the spoils area is completely dry it will be
r)ermanently graded and stabilized in place with a native grass seed mix.

D. Impact Justification and Mitigation

Sediment removal was performed from upstream to downstream and was accomplished using manual labor "bucket
crews". Removed sediment was disi)osed of in the same si)oils Ole that already existed on site which is protected with silt
fence.
b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Sediment removal activities were conducted in the dry to mitigate further downstream migration of sediment. This was
accomplished through the use of a pumr) around or)eration to limit flow volume durinci work. Care was exercised to
ensure that natural channel bed substrate, woody debris, and other important elements of the stream ecosystem were
maintained. All areas along the ftarian corridor that were disturbed during sediment removal were seeded with a native
seed mix and mulched with straw to minimize further erosion potential. This material in the spoils area was smoothed and
will be Permanently stabilized in Oace with native -grass seed mix once the sediment dries out.

vinginiana. or Geum radiatum, and there are no caves to support Myotis grisescens. UT -Dix Creek in the Promect Site likely

area to support Sacittaria fasciculata and no shady vertical rock faces to support Cetradonia lineafis. Plans did not call for the
removal of any trees, avoidina habitat disturbance to Myotis septentfionalis.
