Enclosed please find four copies of the Pre -Construction Notification (PCN) that has
been prepared for the above referenced property, located west of NC22, in Southern Pines,
Moore County, North Carolina. The proposed institutional development plan will permanently
impact 0.25 acre and temporarily impact 0.15 acre of riparian wetland (0.4 acre total wetland
impacts) for construction of a road, removal of a pedestrian footbridge, and improvement of an
existing road. It appears the project meets the. conditions of and can be authorized by
Nationwide Permit 39. (WQC# 4092).
Also enclosed is a check made payable to the NC Division of Water Resources in the
amount of $240 for the application fee.

Subject site is currently undeveloped (wooded, with existing soil paths and sewer/water utilities). Adjacent site is
institutional. Land use in the vicinity is undeveloped (wooded) and residential.

Explain the purpose of the proposed project:
Construct an institutional building and parking. The proposed wetland impacts are associated with construction of the
access road.

Describe the overall project in detail, including the type of equipment to be used:
A road will be constructed across the wetland (Impacts W1 and W2), from the site entrance on Hwy 22 to the new
building and parking areas. Retaining walls (up to 16ft tall) will be used instead of fill slopes along the road. Three 5'X 5'
RCP Box culverts will be placed under the roadway, with a 22'X 40' riprap dissipater at the downstream end of the pipes.
Temporary sediment and erosion control devices will be installed adjacent to the road (Impacts W3 and W4). An existing
pedestrian bridge will be removed (Impact W5). An existing asphalt road will be improved (Impact W6). Typical
construction equipment such as excavators, bull dozers, and pans will be used.

The stormwater runoff from the site discharges to the North and South of the site. The site is within the Cape Fear River
basin and peak stormwater discharges shall meet pre -development rates for the 10 -year 24-hour design storm as well as
providing 85% removal of total suspended solids for any impervious area. One (1) Bio -Retention Cell and two (2) Stormwater
Wetlands were designed to control the runoff from the site to meet the predevelopment peak flow of the 10 -year 24-hour
design storm.

endangered, proposed and candidate species, as well as proposed and final designated critical
habitat. that may occur within the boundary of your proposed project and/or may be affected by

Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended

federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the

Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to _jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or
evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the
web site often for updated information or changes
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require

Dear Ms. Sabo:
The Fish and Wildlife Service (Service) has reviewed your January 6, 2017, email and associated
document titled "Red -cockaded Woodpecker Biological Assessment for the Advanced Career Center,
Southern Pines, Moore County, North Carolina." Sandhills Community College (SCC) proposes a land
transaction with Moore County Schools to create a location for the future Advanced Career Center
(ACC). The proposed project is within the 0.5 -mile radius foraging partition for one abandoned cluster
(SOPI 87) of the federally endangered red -cockaded woodpecker (Picoides borealis; RCW). Our
comments are provided in accordance with sections 7 and 9 of the Endangered Species Act (Act) of
1973, as amended (16 USC 1531 et seq.).
SCC proposes to donate about 22 acres east of, and adjacent to the current Moore County Schools
campus for the project. The project would include construction of a new building, two future attached
buildings, four storm water retention ponds, four parking lots (441 total parking spaces), an enclosed
yard, an access road connecting with NC Highway 22 and an access road connecting with the SCC
campus. The ACC campus would be accessed from Highway 22, through an easement with SCC.
According to the biological assessment, the project would result in the loss of some potential foraging
habitat associated with RCW cluster SOPI 87, an abandoned Safe Harbor recruitment cluster. The
affected cluster is comprised of 12 cavity and cavity start trees, none of which are currently active. The
biological assessment states that SOPI 87 was last active in 2004 when a solitary male occupied the
territory.
The proposed project falls within the 0.5 and 0.25 -mile radius foraging partitions for SOPI 87 and
within 200 feet of two relic cavity trees, tag #s 1480 and 1481. Since SOPI 87 is currently unoccupied
and has not been active in over five years, a full foraging habitat assessment was not conducted.
However, the 0.5 -mile radius partition contains approximately 369.43 acres, of which 231.57 acres are
pine forested, 8.75 acres are lowland hardwood, 24.35 acres are open water and 104.76 acres are non -
foraging habitat (e.g., roads, buildings, open land, etc.). The proposed ACC would remove about 20.13
acres of pine forest, leaving approximately 21 l .44 acres of suitable and potentially suitable habitat.
Sufficient acreage would remain in the 0.5 -mile radius foraging partition to support a RCW group if the
cluster is reactivated.
Annual cluster monitoring has shown that at least one cavity tree in SOPI 87 has been identified as
being possibly active prior to each breeding season; however, no RCWs have been detected in the
cluster during the breeding season. Based on the distribution of pine forest on the SCC and neighboring
properties, the remaining habitat is important to RCW conservation in Moore County, as foraging,
dispersal and nesting habitat. For a variety of reasons, SOPI 87 has remained inactive for several years.
In its current configuration, the cluster may be too close to occupied RCW territories to the west (SOPI
34 and 35) and/or the distance between SOPI 87 and active territories to the northeast and southeast
have a negative effect on SOPI 87's ability to recruit resident RCWs.
While not a required condition of the Service's concurrence, we believe it is important to recommend
appropriate measures that may be carried out on SCC property that are likely to further benefit RCW
conservation. Rather than focusing cluster management within the current cavity tree aggregation at
cluster SOPI 87, it may be more productive to shift the cluster center about 1,100 feet due east, and
provision new cavities (a minimum of four) in trees on SCC land between the ACC project access road
on NC 22 and the Tyler's Ridge at Sandhills Apartment Homes. Moving the cluster east may reduce
territorial conflict with woodpecker groups to the west and improve the potential for a new breeding
group to form. These cluster management activities, in combination with prescribed burning or
chemical/mechanical midstory control, would be likely to promote RCW group resilience in Moore
County and support the overall health of the RCW recovery populations in the North Carolina Sandhills.
Based on the information contained in your January 6, 2017 email and biological assessment, the
Service concurs with your determination that the proposed tree removal may effect but is not likely to
adversely affect the red -cockaded woodpecker (Picoides borealis; RCW). We believe that the
requirements of section 7(a)(2) of the Act have been satisfied. We remind you that obligations under
section 7 consultation must be reconsidered if. (1) new information reveals impacts of this identified
action that may affect listed species or critical habitat in a manner not previously considered; (2) this
action is subsequently modified in a manner that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.

The site is located approximately 0.75 miles South of the intersection of Central Drive and Airport Road
along the Western side of Central Drive in Southern Pines, NC. The 17.51 -acre site is currently within
the Town of Southern Pines municipal limits. The project will impact approximately 16 acres of the site
and approximately 6.5 acres of the surrounding property for road connectivity.
The stormwater runoff from the site discharges to the North and South of the site. The site is within the
Cape Fear River basin and peak stormwater discharges shall meet pre -development rates for the l0 -year
24-hour design storm as well as providing 85% removal of total suspended solids for any impervious
area. One (1) Bio -Retention Cell and two (2) Stormwater Wetlands were designed to control the runoff
from the site to meet the predevelopment peak flow of the 10 -year 24-hour design storm.
FEMA FIRM # 3710857300J and # 3710858300J dated October 17, 2006 indicate that the site is outside
the limits the 100 -year flood plain.
Soils on the site consist predominately of Candor Sand (90.5%), and Ailey Loamy Sand (9.5%). These
soils represent Hydrologic Soil Groups (HSG) A and B respectively. An HSG of A was used to perform
stormwater calculations.
Stormwater Management Methodology
Stormwater Quantity
The site stormwater quantity analysis was performed at Analysis Points 1, 2, and 3. Analysis point 1 is
on the Northern side of the property, analysis point 2 is on the South -East side of the property and
analysis point 3 is on the South-West side of the property. One (1) Bio -Retention Cell and two (2)
Stormwater Wetlands were designed to control the runoff from the site to meet the predevelopment peak
flow of the 10 -year 24-hour design storm.
The time of concentration (Tc) calculations utilize the TR -55 method by the United States Soil
Conservation Service (SCS) while maintaining a minimum Tc of 5 minutes (user input) for smaller
drainage areas. The stormwater and BMP managed flow calculations were performed with Hydraf7ow
Hydrographs Extension for AutoCAD Civil 3D software which utilizes the TR -55 method.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the
table below. Please note that this decision does not assure that participation in the DMS in -lieu fee mitigation
program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility
of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must
also comply with all other state, federal or local government permits, regulations or authorizations associated with
the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. ff we have not
received a copy of the issued 404 Permit/401 CertificationlCAMA permit within this time frame, this
acceptance will expire. It is the applicants responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an
applicant is calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
