Subject: Assessment of Civil Penalties for
Hawthorne Subdivision WWTP (NC0049662),
Cole Park Plaza Shopping Center WWTP
(NC0051314), and
Governors Club WWTP (WQ0000088)
Wake and Chatham Counties
Dear Mr. Becker:
Enclosed are three civil penalty assessments for violations occurring at the Hawthorne Subdivision
WWTP (NC0049662) located in Wake County, Cole Park Plaza Shopping Center WWTP (NC0051314)
located in Chatham County, and Governors Club WWTP (WQ0000088) located in Chatham County. As
you are aware, there continue to be ongoing compliance problems at these facilities. We consider the
nature and extent of the ongoing violations to be significant.
I appreciate you meeting with us on April 25, 2017 to discuss improved communication between our
organizations. In addition, I am aware of continued meetings between AQUA North Carolina, Inc. and
the Division of Water Resources to discuss the ongoing problems at these and other facilities. The
Division believes that these meetings are valuable and should continue. However, we do remain very
concerned about the state of these facilities. We look forward to working with AQUA North Carolina,
Inc. in the future toward full compliance at all the AQUA North Carolina, Inc. facilities across the State.
If you should have any questions or require any additional mformation, please feel free to contact me at
