The modification is seeking to add 110 square feet of impact to the Zone 1 Buffer for the construction of a wood slatted deck to provide egress from the rear of the house, plus 25 square feet of impact to the Zone 2 Buffer to allow for optimum placement of the front porch. I have also enclosed three copies of the Site Plan, on which the property is identified as Lot 1, and three copies of the Ecosystem Enhancement System Acceptance Letter. I hope this application is sufficient for your consideration of this modification request. If you have any questions, or would like to discuss this matter further, please do not hesitate to call. Requested Environmental Management Commission Hearing Date: Version 1: September 1998 Part 2: Demonstration of Need for a Variance NOTE: The variance provision of the Neuse Riparian Area Rule allows the E_. Management Environmental l Commission to grant a variance to an affected party when the following conditions apply on a given project: (a) practical difficulties or hardships would result from strict application of the rule: (b) such difficulties or hardships result from conditios which are peculiar to the property involved; and (c) the general purpose and intent of the Rule would be preserved, water quality would be protected and substantial justice would be done if the variance were granted. This part of the application is to explain how the project meets criteria (a) and (b). 1. Attach a detailed description (2-3 pages) explaining the following: • The practical difficulties or hardships that would result from strict application of the Rule. • How these difficulties or hardships result from conditions that are unique to the property involved. • Why reconfiguring and/or reducing the built-upon area to preserve a greater portion of the riparian area is not feasible on this project. If economic hardship is the major consideration, then include a specific explanation of the economic hardship and the proportion of the hardship to the entire value of the project. Front porch is situated near center on front of house rather than on front corner of house, to facilitate workable interior floor plan. Only 16 linear feet of front of house at front corner are outside Riparian Buffer. Moderately sized wood slatted deck situated on rear of house to provide rear access, with landing and steps down from first floor elevation to ground elevation. Deck is less that 8' off the ground. Entire rear and both sides of house are within Riparian Buffer. Part 3: Water Quality Protection NOTE; This part of the application is to explain how the project meets criterion (c): the general purpose and intent of the Rule would be preserved, water quality would be protected and substantial justice would be done if the variance were granted. 1. Briefly summarize how water quality will be protected on this project. Also attach a detailed narrative (1-2 pages) describing the nonstructural and structural measures that will be used for protecting water quality and reducing nitrogen inputs to surface water. Same protections and best management practices as described in original variance request (DWO #06-0507) 2. What is the total project area in acres? 0.27 acres (11,939 s.f.) (lot size) 3. Which of the following permits/approvals will be required for this project? CAMA Major Sediment/Erosion Control 401 Certification/404 Permit None Variance Request Form, page 2 Version 1: September 1998 Part 3: Water Quality Protection, continued 4. How was the off-site impervious area listed above derived? The lot is isolated from adjacent stormwater flows by a curb and gutter stormwater collection system that serves the D.L. Johnson Subdivision. No off-site stormwater traverses this property, according to data submitted with original variance request prepared by Robert J. Goldstein and Associates, Inc. 6. What will be the annual nitrogen load contributed by this site after development in pounds per acre per year without structural BMPs (stormwater pond, wetland, infiltration basin, etc)? Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/LAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. River Basin CU Location Stream (feet) Wetlands (acres) Buffer I (Sq. Ft.) Buffer[[ (Sq. Ft.) Cold Cool Warm Riparian Non-Riparian Coastal Marsh Impact Neuse 03020201 0 0 0 0 0 0 110 25 Credits Neuse 03020201 0 0 0 0 0 0 330 37.5 Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S. Army Corps of Engineers dated November 4, 1998. If you have any questions or need additional information, please contact Valerie Mitchener at (919) 715-1973.
