Sullins, Director Division of Water Quality September 29, 2008 DWQ# 06-0690 v4 Randolph County CERTIFIED MAIL: 7008 0150 0002 7876 7563 RETURN RECEIPT REQUESTED Ms. Ann Bailie, City Manager City of Trinity PO Box 50 Trinity, NC 27370 Re: Section 401 Water Quality Certification application Dear Ms. Bailie: On September 5, 2008, the North Carolina Division of Water Quality (Division) received your application for a 401 General Water Quality Certification to temporarily impact 0.072 acres of wetlands and 60 linear feet of streams in order to construct the Phase 4A Sewer Extensions in Trinity NC, in Randolph County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H .0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. Condition #12 of General Certification 3699 requires that utility lines cross a stream at near perpendicular. The crossing shown on Page 16 of the plan sheets, at Station 11+00 appears to be in contradiction with this requirement. Please clarify the angle of crossing at this location and/or clarify if you are requesting an exemption from this permit condition. Exemptions from permit conditions must be clearly justified. 2. Condition #19 of General Certification 3699 requires that the construction corridor through wetlands and at stream crossings be limited to 40 feet. The plans indicate a 40 foot permanent corridor, as well as an additional 10 foot construction easement through wetlands. It appears the construction corridor could be minimized in wetland areas to reduce wetland impacts in accordance with the avoidance and minimization criteria. Please modify the construction drawings appropriately to meet the permit condition and minimize unnecessary impacts. 3. Condition #20 of General Certification 3699 requires that the permanent utility easement through wetlands and at stream crossings be limited to 15 feet. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
