You are correct that the only requirement regarding stormwater runoff for the subject project 401 WQC is to
ensure that stormwater discharges to wetlands are non-erosive (i.e. no more than 2fps). For reference, this
change to 15A NCAC 02H .0506 was required by Session Law 2017-010.

Hi Jennifer,
We wanted to confirm that based on our past conversations in regards to the new law passed that for our project with
the Smithfield Foods Expansion located at 15855 and 16261 NC -87, Tar Heel, NC in Bladen County, we are not required to
treat for 85% TSS removal or design for detention. Our only requirement will be to discharge at a non-erosive velocity (<2
ft/s) to the wetlands. No other design for stormwater will be required. I've also CC'd Sue as well if you have any other
concerns, please let us know.
