Dear Mr. Rivera:
On March 20, 2017, the Washington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of your CAMA application for a project located at 101 N. Granby St,
Hertford, NC. The proposed development included a 20 -slip docking facility, travel lift piers and
bulkhead. The proposed water dependent structures are associated with the development of a
future marina at this site. Through discussions with several review agencies, you were advised that
the future marina will require a State stormwater permit prior to any upland development; and a
Federal stormwater permit prior to the operation of any industrial activities at the marina.
By letter dated May 2, 2017, your consultant, Mr. Hal Goodman, provided additional
information, along with a conceptual plan for the marina. The conceptual plan is not adequate to
conduct a formal review, nor determine whether the necessary stormwater permits may be issued
for this project. For this reason, we are considering the information provided for this CAMA Major
application to be incomplete and updating our stormwater files to show this project as "returned".
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement actions by
this Office.
Please keep in mind that this determination does not affect your legal obligation to obtain
other permits and approvals, which may be required by Federal, State, or local government
agencies, rule or law. If you have any questions, or need additional information concerning this
