Kevin,
After reviewing this project further and coordinating with the ACOE, I have determined
that this work is actually covered by NWP 3 maintenance, so written 401 certification
should not be necessary. The project site is a non-trout watershed and so in addition to
other conditions, it is exempt from submittal of a PCN to the ACOE. We will adhere to
the NWP 3 conditions and GC 4085.
Please advise if you have any questions or need additional information.
