Not sure why it matters…we could do maintenance at any given time on our measures if needed. Does he expect you to come
out every time we do maintenance on a measure in the vicinity of the pond? We have a delegated program to DOT from DEMLR
and the EMC to handle the Sediment and Erosion Control Act. My suggestion to you would be to notify Mr. Tabor that the
maintenance of erosion control measures is not DWR’s responsibility and get DWR out of the middle of the maintenance of the
erosion control measures. The NPDES and 401 permits require us to be in compliance with our erosion control plan, but the
Sediment and Control Act is not enforced by DEQ, its enforced by DEMLR. And its very hard for DEQ to enforce the condition in
the 401 and NPDES permit without DEMLR agreeing that a permittee is not in compliance with the plan.

We make repairs to our measures as needed which is part of our erosion control plan. We did not rebuild the basin, but we did
do some routine maintenance on inlet end of the basin. We talked about it in our meeting with you last week. It was the first
time the basin had needed maintenance in a while, and it was the result of the rains. Mr. Tabor has already spoken with our
DOT staff regarding the recent maintenance to the measures.

Hi Amy and Phil,
Has DOT made modifications to the above Skimmer Basin? Mr. Tabor informs me that the basin was rebuilt recently. I’m
assuming that what he observed was maintenance/cleaning of accumulated sediment. Please explain. Thanks.
