The revisions to the application are a result of redesign of the access entrance to conform to the City of Wilmington Ordinance for access. The revisions to the site plan will result in 40 if ft of stream impacts and 1,685 sq ft (0.04 ac) of wetland impacts. The proposed wetland and stream impacts occur at two separate locations; the culvert crossing and the wetland crossing. The design of the installation of the culvert crossing has been revised to utilize headwalls to stabilize fill rather than back-slopes. The culvert crossing was also redesigned to remove the proposed rip-rap originally designed to be placed in the bottom of the stream bed. The revisions to the culvert crossing result in a reduction of 34 if of stream impacts and 298 sq ft of wetland impacts from the previously submitted site plan. The redesign of the access road also required widening of the access road, resulting in an additional 316 sq ft of wetland impacts needed to cross the wetland finger. While the proposed wetland impacts needed to cross the wetland finger increased, the minimization of impacts at the culvert crossing result in an overall increase of only an additional 18 sq ft of wetland impacts and the minimization of 35 if of stream impacts. Therefore, the revisions to the application are a result of an increase of 18 sq ft of wetland impacts and a reduction of 34 if of stream impacts. The project is located at 7621 Masonboro Sound Road, in Wilmington, New Hanover County. The project is ±5.11 acres in size, and abuts the marsh adjacent to Masonboro Sound/AIWW. The project is located within the planning jurisdiction of the City of Wilmington. The City of Wilmington will provide the drinking water supply source and the Cape Fear Public Utility Authority will provide the sanitary sewer for the project. The proposed utilities will consist of a 4" sewer line and a 1" water line, which are concurrent with standard single family residential use. Areas of Environmental Concern (AEC) The AIWW is classified as ORW and is afforded a 575' Area of Environmental Concern (AEC). The 575' AEC was offset from the NHW line from the marsh adjacent to the AIWW. The NHW line was established by Robb Mairs with the NC Division of Coastal Management (DCM) on January 3, 2008. The entire 222,506 sq feet (5.11 acres) of the project site is located within the 575' AEC. The project will result in 10,873 sq feet (0.25 ac) of impervious area within the 575' AEC needed for construction of the house and access road, resulting in 4.8% impervious area proposed within the 575' AEC. There is no proposed construction within the 30' Coastal Shoreline Buffer. There is no proposed construction within the 30' Coastal Shoreline Buffer. The access road will consist of both asphalt and gravel portions. The first 180 ft of the access road will be paved with asphalt to provide a stable base for vehicles to drive up the steep slope to the house. The remainder of the driveway will consist of gravel. The 40 if stream impacts will occur to an unnamed tributary that borders the property to the west and south, and eventually drains into Masonboro Sound/AIWW. Dual 48" culverts will be installed within the stream during construction of the entrance road. The culverts will be installed approximately 1.0 feet below the existing stream bed to allow for passage of water and aquatic life during periods of low flow. A total of 1,685 sq ft of wetland impacts are proposed to construct the access road. The installation of the culvert crossing will result in 471 sq feet of wetland impact, and construction of the wetland crossing will result in 1214 sq ft of wetland impacts. Due to the location of the onsite wetlands, the entrance road could not be constructed entirely in uplands. The wetland impacts have been minimized to those necessary for the construction of the access road. There are no wetland impacts associated with construction of the proposed house. Avoidance and Minimization Impacts to onsite wetlands and streams have been avoided and minimized to the greatest extent possible. The proposed wetland/stream impacts have been minimized to those necessary for construction of the access entrance. The stream crossing has been designed to utilize a headwall to stabilize fill rather than backslopes. Also, the previously proposed rip-rap has been removed from the actual streambed. These minimization efforts have resulted in a 35 If reduction in stream impacts needed for construction of the stream crossing. Wetland impacts were also avoided through the design of a retaining wall on the southern edge of the guest house. The proposed retaining wall will be built into the southern wall of the guest house. Due to the topography of the southeastern portion of the site, the retaining wall was necessary to allow for construction of the guest house without impacting wetlands. Mitigation In order to compensate for the proposed 40 if of stream impacts and 1,685 sq ft (0.04 ac) of wetland impacts the applicant proposes to purchase 0.25 acres of riparian wetland mitigation from the Ecosystem Enhancement Program (EEP). Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net, Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S.
