The attached notice requests federal agency comments on this project by May 25, 2017. The applicant proposes to replace an existing community docking facility within Howe Creek. The project consists of removing the existing docking structure and replacing (within the same alignment) a 6'x 185' access pier, with a 16' x 16' fixed docking platform at the end. A 7' x 70' floating dock is proposed to replace the existing facility to accommodate up to 5 vessels. The proposed project is located at 6601 Sylvan Lane, within Howe Creek, Wilmington, New Hanover County, North Carolina. Coordinates in Decimal Degrees are: 34.253361 N, -77.793261 W. Additionally, a Google Earth .kmz file is attached for reference. Please see the attached Bioreport /CAMA application for more detailed information concerning the proposed project. This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but will not likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to previous impacts at the location and the temporary nature of sedimentation impacts. No new permanent impacts to coastal wetlands are proposed. The waters within the project area are designated as PNA, but no loss of PNA is expected and all impacts are proposed to be temporary in nature. SAV is not expected to be present based on aerial imagery of the project location. The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project will not affect any species listed as threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area or in the area of the disposal. Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected.
