It was determined that the current proposed action is essentially the same as the original proposed action. Proposed changes, if any, are noted below in Section III. It has been determined that anticipated social, economic, and environmental impacts were accurately described in the above-referenced document unless noted otherwise herein. Therefore, the original Administration Action remains valid. CHANGES IN PROPOSED ACTION AND ENVIRONMENTAL CONSEQUENCES Roadwav Desi�n Chanses This Construction Consultation was a result of a design change requested by local officials. The change requested was modifying the EIS design of an at-grade intersection at the NC 24/NC 242 intersection to an interchange. The primary reason for the requested change is to improve the connectivity between Salemburg and Roseboro. The access-controlled interchange design now includes 2-way ramps in the NE and SW quadrants. The design changes also include access to SR 1300 (North Street) and two additional service roads to provide access to landlocked properties. No changes to the design speed are proposed. These changes will require 13.19 acres of additional right-of-way acquisition and 1.48 acres of additional temporary and permanent easements. There are no additional residential or business relocations anticipated. See Figures A and B for the previous at-grade intersection design and new interchange designs, respectively. Water Resources Update Water resource classifications have not changed since the FEIS was completed. No jurisdictional streams occur within the study area. There are 0.04 acres of additional wetland impacts within the study area. The impacted wetland was a wetland identified during the initial study area and natural environment investigation located in the NE quadrant ofthe proposed interchange left of proposed NC 24 approximate -L- Station 849+40. There are no waters within the project vicinity classified as High Quality Waters (HQW). Neither Water Supplies (WS-I: undeveloped watershed or WS-II: predominately undeveloped watersheds), nor Outstanding Resource Waters (ORW) occur within 1.0 mile of the project study area. Federallv Protected Saecies Uadate Plants and animals with federal classifications of Endangered (E), Threatened (T), Proposed Endangered (PE), Proposed Threatened (PT), are protected under provisions of Section 7 and Section 9 ofthe Endangered Species Act of 1973, as amended. As ofJune 15, 2016, the U.S. Fish and Wildlife Service listed 4 federally-protected species for Sampson County. A description of these species is provided in the referenced FEIS. No specimens were found. A review of the North Carolina Natural Heritage Program (NCNHP) database on July 28, 2016, indicated non occurrences of the above species within one mile of the project study area. Therefore, the biotogical conclusion of `No Effect' has been determined. Ba/d and Golden Eagle Protection Act (BGPAJ In the July 9, 2007 Federal Register (72:37346-37372), the bald eagle was declared recovered, and removed (de-listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8, 2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) became the primary law protecting bald eagles. Habitat for the bald eagle is not present due to the lack of large water bodies in the study area. P1 V. Noise Abatement Per the noise requirements of 23 CFR 772 and the NCDOT Traffic Noise Abatement Policy and the NCDOT TrafFic Noise Analysis and Abatement Manual (effective July 2011), a review of the noise analysis presented in the EIS and ROD was conducted. The proposed interchange is not expected to impact any new receptors within the area of the interchange. Additionai detailed study of potential mitigation measures shall not be necessary unless modifications to the presently considered alternative occurs, additional alignments are considered, or changes to the design year traffic volumes are predicted. At the small group meeting held on August 3, 2016, citizens did not have any concerns with noise within the area of the interchange. Communitv Studies and Public Involvement Update A combined local officials meeting and small group meeting was held on August 3, 2016 to inform affected property owners of the design changes. Based on the feedback from local officials and citizens at the meeting, the proposed interchange is generally viewed favorably and will not result in new adverse impacts of significance within the community. Since the Selected Alternative will have an adverse effect upon these archaeological sites and preservation in place is not possible, NCDOT will develop a Data Recovery Plan (DRP) in consultation with the North Carolina State Historic Preservation Office (HPO). The DRP will be implemented in accordance with the Memorandum of Agreement signed by FHWA and the HPO on August 27, 2010. This commitment is related to Sections D and F of the project. Widening will be away from house (i.e., to south). NCDOT will develop a landscaping plan along the new road (to be reviewed by the North Carolina State Historic Preservation Office). Proposed borrow sites designated by the contractor will be investigated and tested for invasive plant species of Japanese knotweed (Reynoutria japonicaJ. EPA should be consulted concerning known locations of the Japanese knotweed colonies in the project area. This commitment will be addressed when the contractor identifies borrow sites. Right-of-Way Branch, PDEA — Human Environment Unit — Burial Sites (new commitment) 1. The Human Environment Section and Right-of-Way Branch are awpre of multiple graves in Hollywood Cemetery that are located in close proximity to the newly proposed right-of-way. Although we had identified a portion of the isolated wetland in the northeast quadrant of the proposed interchange as being impacted, these plans would indicate that we are likely not going to incur the additional .004 acre impact. I have included Ron Lucas on this reply email to let him know that the impacts in the consultation he reviewed were (very slightly) over reported.
