Dear Mr. Greeson:
The Division is beginning the cycle of permit renewals for the Cape Fear river basin. An examination of the Cape
Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES
permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary
delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for
NPDES permits in the Cape Fear river basin.
This permit modification changes the expiration date of the subject permit in subbasin 30607 to July 31, 2001. Please
find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All
other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification
is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency.
In accordance with the modification of the permit expiration date, the new due date for your renewal application is
February 1, 2001. Renewal application forms will be sent to you approximately 6-8 weeks in advance of the new due date
or you may download the forms from the NPDES web site at http://h2o.enr.state.nc.us/NPDES/documents.htmi.
You will need to download Standard Form C. If you have already submitted a permit renewal form, there is no need to
submit any other forms to the Division; the application will be processed during the renewal period for your subbasin.
If any part of this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming
to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

This permit shall become effective September 1, 2000.
This permit and authorization to discharge shall expire at midnight on July 31, 2001.

Louise- I talked with Kevin Bowden of our Aquatic Toxicity Unit (ATU), whose
Unit reviews the MSDS/Biocide Worksheets submitted. Generally the ATU wants to
review MSDS/Biocide Worksheets for chemicals added to non -contact cooling water
discharges, since these discharges usually don't have toxicity tests in their
permits. For CP&L's situation, the boiler discharge ultimately goes through
Outfall 007 (combined wastewaters), which does have a permit limit for chronic
toxicity in place. Therefore, DWQ approval of the proposed chemical is not
necessary, since the tox test at Outfall 007 will monitor any impact. However,
Kevin suggested that you could still send the MSDS/Biocide data to ATU for
review, just to make sure of no potential toxicity.

Louise- hope the following helps:
NC0001422 (Sutton Steam). It sounds fine to sample from the cooling pond just upstream of the discharge
point.
NC0003433 (Cape Fear). If you just summarize what was collected over the last permit round, this should
suffice for the permit renewal.

discharge from their cooling pond (outfall 001) this summer. We will not be
able to sample a discharge for the NPDES permit renewal sampling. We
request permission to sample the cooling pond from immediately upstream of
the discharge point.
Cape Fear Plant is also preparing to sample for their permit renewal. The
last discharge from outfall 008 (stormwater from the abandoned ash pond) was
in April of 1998. Plant staff do not expect to receive rainfall sufficient
to produce a discharge from this outfall so we will be unable to include
sample data for their permit renewal. Will there be a problem with this?

Louise- 2 talked further with Dave Goodrich about this request, and we still
feel that this spent resin should be treated as a solid waste disposal issue,
rather than through the NPDES permit. This is consistent with our recent
denial of another request to dispose of a solid waste byproduct via the NPDES
permit. Please call if you have further questions.

Louise- I took a quick look at the NPDES permit and have some additional
questions. The big question would be whether this spent material should be
disposed as a hazardous waste or to a landfill as solid waste, rather than
through the NPDES permit for wastewater disposal. Do you know of any other CP&L
facilities where DWQ has allowed this? I wouldn't expect the spent material to
be hazardous, but is there any supporting chemical data. Finally, when you
refer to the old ash pond, which Outfall are we discussing and where would the
discharge go to? Unfortunately more questions than answers! I'll be back in
the office 11/29 if you want to discuss further.

The subject inspection was performed on August 26, 1999, by myself. The cooperation of
Danny Hedgepeth (ORC) was appreciated. This inspection did not evaluate the performance of
the individual treatment units, laboratory, or review the records. During the inspection the
following treatment units appeared to be operational:
- "old, old ash pond" (Outfall 008): ash pond not in use, but stormwater has a discharge
pipe (no discharge during inspection);
- "west ash pond" (Outfall 001): some water discharged to pond (not ash water); water
was discharging to effluent canal during inspection (effluent appeared clear);
- "east ash pond" (Outfall 005): ash pond currently in use for plant ash wastewater and
small package plant effluent water; water was discharging to the effluent canal during
inspection (effluent appeared clear);
- "cooling water" (Outfall 003): river water that is pumped through the cooling towers
and allowed to flow into the effluent canal; water was silty (brown like the river water)
during the inspection;

- "combined discharge point" (Outfall 007): location of effluent canal that final sampling
takes place (contains wastewater effluent from Outfalls 001, 003, and 005); water was
silty (brown like the river water) during the inspection (the vast majority of the volume is
the "cooling water");
- the domestic wastewater package plant was operational and had chlorine tablets.
The pH meter calibration was checked since it was mentioned in one of the previous inspection
reports. The operator uses a 3 point calibration, as required.

Dear Ms. England:
Based on your conversation with Ms. Susan Wilson and subsequent facsimile transmission
August 19, 1999; the Division understands that CP&L has requested approval for pilot testing GAM -60
at both the Weatherspoon and Cape Fear plants. GAM -60 (essentially boric acid) is to be used to
increase the heat transfer of the furnace walls at the facilities.
As stated in your facsimile, any residue of GAM -60 will be routed through the ash sluice lines
to the ash ponds at each facility. Any residue of GAM -60 or derivative compounds would essentially be
diluted to negligible levels (if detectable) in the fmal outfall to the receiving stream, when used at the
amounts proposed by CP&L.
This letter constitutes approval of the GAM -60 compound at both the Weatherspoon and Cape
Fear facilities.
