Subject: NPDES PERMIT APPLICATION AMENDMENT
Dear Mr. Vinzani,
Progress Energy's Cape Fear Plant is proposing to amend their current NPDES
permit application (submitted January 26, 2001) and their NPDES Permit
Renewal Application (submitted January 23, 2006) for the subject facility. The
amendment includes the following item:
Burying Coal Mill Reiects in the West Ash Pond
As a corporation Progress Energy is beginning to take measures at many of its
coal-fired plants to dispose of unusable coal combustion products. Therefore,
the Cape Fear Pant would like to amend its current NPDES permit application
and its renewal application to allow for the burial of coal combustion products
(mill rejects) in the west ash pond. The products will be segregated into an
isolated area of the pond, above the water line, buried under ash; and sloped to
encourage storm water runoff from rather than through the capped material.
There will be no contact between water inside the ash pond and the mill rejects.

This is in response to your letter dated June 21, 2006, regarding burying coal mill rejects in the West Ash Pond at the Cape
Fear Plant. We understand that mill rejects will be buried under the ash. As long as they will be segregated in an isolated
area of the pond, above the water line, I believe that there will be no effect on water quality. Specifically, we would expect no
changes in the quantity or quality of the discharge from the ash pond.
In order to route storm water discharge away from the capped material, please provide a suitable slope to the contour of the
pond.
Since there will be no contact between water inside the pond and the mill rejects, we have determined that a permit
modification is not necessary. If you have any questions, please call me at 733-5083, ext. 540.
