On July 5, 2016, the Division of Water Resources (Division) received your application dated June 2, 2016,
requesting a 401 Certification from the Division for the subject project. We wrote to the US Army Corps
of Engineers on July 21, 2016 requesting additional information on the project, which was forwarded to
your consultant. On September 15, 2016, David Syster of Southern Environmental Group, Inc. sent an
email to the Division stating that the information would be submitted by September 23, 2016. As of
today, the Division has not received this information. Additionally, the US Army Corps of Engineers
withdrew the Section 404 application by letter dated April 13, 2017.
Pursuant to Title 15A NCAC 02H .0507(e), the Division is unable to approve your application. For the
reasons listed above, your application is hereby returned. Once you have addressed the problems and/or
inadequacies with your application as it was submitted, you will need to reapply to the Division for
approval including a complete application package and the appropriate fee.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for this activity
and any work done within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
