Sullins, Director Division of Water Quality DWQ Project # 08-0867 Johnston County Subject Property: Millstone Ridge Subdivision - AFTER-THE-FACT Ut Hooks Branch - Black Creek [030404, 27-45-4, C, NSW] RETURN OF APPLICATION Gentlemen: On May 22, 2008, the Division of Water Quality (DWQ) received your After-The-Fact application dated May 20, 2008, to fill or otherwise impact 0.222 acres of 404/wetland, 107 linear feet of perennial stream impact and 5,750 square feet of Zone 1 Neuse River basin protected riparian buffer, and 2,446 square feet of Zone 2 Neuse River basin protected riparian buffer to construct the residential development at the site. On July 25, 2008, the DWQ received additional information from you, however, the DWQ has determined that your application remains incomplete and/or provided inaccurate information as discussed below. In the June 26, 2008 Request for More Information Letter, the DWQ requested: "For each proposed level spreader, please provide a Level Spreader Supplement Form with ALL required items attached." The most recent submittal failed to plan details of each level spreader showing the forebay, high flow bypass system, one-foot topographic contour lines and recorded drainage easement (see Item #2 of the required items check list). For these reasons your permit application is hereby considered returned. Once you have redesigned your project to address the problems and inadequacies with your application as it was submitted, you will need to reapply for DWQ approval. This includes submitting a complete application package with the appropriate fee. Please be aware that you have no authorization under Section 401 of the Clear Water Act for this activity and any work done within waters of the state would be a violation of North Carolina General Statutes and Administrative Code.
