8. PROJECT SUIVIMARY:
The applicant proposes to construct a 117-foot long retaining wall and a four bedroom
single-family house.
Project Setting
The proposed project will be constructed at 53 Ballast Point Drive, an undeveloped lot in the
Pirates Cove subdivision located approximately .75 miles northwest of the U.S. 64/264
Washington Baum Bridge linking the towns of Manteo and Nags Head. The lot is bordered
by Ballast Point Drive to the west and the Roanoke Sound to the east, which is
approximately two miles wide at this location.
The adjacent riparian property to the south contains a pier and large single-family residence
protected by a bulkhead and breakwater. Many of the other lots located both north and south
of the subject property also contain piers and are equipped with retaining walls/bulkheads
and breakwaters to reduce the effects of wakes from large boats utilizing the channel that
parallels the shore of the Pirates Cove subdivision.
The lot located immediately north of the subject property is an undeveloped area owned by
the subdivision. It contains the remnants of a small creek that is separated from the adjacent
Roanoke Sound during times of normal water level by a small strip of sand sparsely
vegetated with grasses and weeds. However, this small strip of sand is over washed during
high lunar tides and during easterly winds. This regular flooding has contributed to the
formation of an area of U.S. Army Corps of Engineers Section 404 wetlands and Division of
Coastal Management (DCM) Coastal Wetlands along the shores of the remnant creek.
This wetland area forms the northern portion of the subject lot located at 53 Ballast Point
Drive. The Coastal Wetlands located immediately adjacent to the remnant creek contain
primarily black needle rush (Juncus romerianus) with scattered sawgrass (Cladium
jamaicense) and giant cordgrass (Spartina Cynosuroides). As the lot transitions from
wetlands to upland, the vegetation changes to indigenous grasses, weeds, and bushes
including eastern baccharis (Baccharis halimifolia), Carolina bay (Persea borbonia), and
panic grasses (Panicum species). The upland portion of the lot located on the southern half
of the property has been graded and planted with lawn grasses and ornamental shrubs.
Elevations across the lot at 53 Ballast Point Drive range from zero along the Roanoke Sound
to the east and the remnants of the small creek to the north, to five feet along Ballast Point
Drive to the west and the developed lot to the south. The lot is located in an AE 10 Flood
Zone.

Project Description
The applicant proposes to construct and backfill a 117-foot long retaining wall in order to
prevent flooding and create enough upland area to construct asingle-family residence. The
retaining wall will be constructed in a northwest to southeast orientation on the landward
edge of the Coastal Wetlands delineated by DCM staff and will connect to a retaining
wall/bulkhead located on the lot immediately south of the subject property. Backfilling the
four-foot tall retaining wall will require 45 cubic yards of soil that will be trucked to the site
from an upland source.
Once the retaining wall is in place, the applicant proposes to construct a four bedroom
single-family residence with a total footprint of 1901 SF. The house itself will have a 1510
SF footprint, covered decks and porches will have a total area of 391 SF, and uncovered
decks and stairs will comprise 277 SF.
9. ANTICIPATED IMPACTS
It is anticipated that the proposed project will cause the following impacts:
• The installation of the proposed retaining wall will result in the filling of 490.4 SF of COE
Section 404 wetlands located in the 75-foot Estuarine Shoreline AEC, including 86 SF
located in the 30-foot buffer. No Coastal Wetland fill is proposed.
• The proposed single-family house will create 1,070 SF of impervious surface in the 75-foot
Estuarine Shoreline AEC; approximately 17 % of the 6,072 SF of Estuarine Shoreline AEC
present on the subject property.
• The proposed single-family house will also include 250 SF of uncovered decks and stairs
located in the 75-foot Estuarine Shoreline AEC.
• A review of available maps indicates that no archaeological resources are located on or near
the subject property.
• The proposed development will result in the disturbance of 3,146.8 SF of area, including
1,837.3 SF located in the 75-foot Estuarine Shoreline AEC.

The applicant owns the subject property which is currently a vacant lot in an approved
subdivision adjacent to Roanoke Sound. The shoreline is subjected to the effects of an
approximately 1.5 mile fetch across Roanoke Sound from a northeasterly direction.
Construction details, cross section views, exact elevations, and exact design of the home
are not available as of the date of this application. These details will be presented and
reviewed for approval as required for the Dare County building permit application.
The purpose for this application is to allow the use of the property as a residence while
adhering to all zoning guidelines for setbacks, etc. The purpose of the retaining wall is to
facilitate the home placement which included decking and stairs in the AEC. A single-
family home will be constructed on the subject site, as indicated by the footprint shown
on the preliminary plan, and as indicated on the cross-section, showing the approximate
design. It is anticipated that the areas of disturbance on the property will be greatest
where construction, grading and filling are proposed (retaining wall, fill areas, building
footprint, driveway). The Dare County Flood Plain designation is AE 10.
The proposed retaining wall will form one continuous protective structure serving to
stabilize the footings and foundation for the proposed dwelling. The retaining wall will
serve as protection during storm events and will prove vital to the stability of the porches,
decks and stairway.
The location and orientation of the home has been shifted as far south as feasible to
minimize wetland impacts. The design as proposed successfully avoids any fill activities
in Coastal wetlands identified onsite. The applicant and contractor shall confirm that the
proposed structures meet or exceed the DARE COUNTY BUILDING CODE at time of
construction.
