Division of Water Quality (DWQ) on May 24, 2004. After reviewing your application, we have decided that the impacts are covered by General Water Quality Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non- discharge regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached certification and any additional conditions listed below. The Additional Conditions of the Certification are: N. C. Impacts Approved - The following impacts are hereby approved as long as all of the other specific and general conditions of this Certification (or Isolated Wetland Permit) are met. The required area of mitigation to compensate for impacts to the protected riparian buffers is 47,165 square feet as required under this Authorization Certificate and 15A NCAC 2B .0242(buffer mitigation rule). We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Ecosystem Enhancement Program (EEP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242(7)(buffer mitigation rule), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233 (10) (buffer protection rule). Until the EEP receives and clears your check (made payable to: DENR - Ecosystem Enhancement Program Office), no impacts specified in this Authorization Certificate stall occur. The EEP should be contacted at (919) 733-5208 if you have any questions concerning payment into the Riparian Buffer Restoration Fund. You have one month from the date of this approval to make this payment. For accounting purposes, this Authorization Certificate authorizes payment into the Riparian Buffer Restoration Fund to compensate for 47,165 ft2 of required riparian buffer mitigation for impacts to 24,899 fe of protected riparian buffers; 03-04-02 river and subbasin, 27-33-(10) stream index number. 3. Construction Plans - Any final construction plans for this project must include or reference the application and plans approved by the DWQ under this authorization letter and certification. 4. Water Quality Certification(s) - The proposed project must comply with all of the conditions of General Water Quality Certification(s) (GC) 3404. 5. Culvert Pipe Installation - Culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the stream up or down stream of the culvert(s). Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. 6. Protective Fencing - The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange warning fencing (or similar high visibility material) for the areas Wake Estates LLC / DWQ Project No. 04-0849 Page 3 of 4 July 16, 2004 that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance.with 15A NCAC 2B .0233 and GC 3404. 7. Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. 8. No Waste, Spoil, Solids, or Fill of Any Kind - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas biyond the footprint of the impacts depicted in the Pre-Construction Notification. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed. so that no violations of state water quality standards, statutes, or rules occur. 9. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 10. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon expiration of the 404 or CAMA Permit. If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Dorney and Zarzecki: On behalf of Wake Estates LLC, we request authorization from the US Army Corps of Engineers (USACE) to use Nationwide Permit (NWP) 14 for the proposed project to cover permanent impacts to one stream channel. We also request written concurrence from the NC Division of Water Quality (NCDWQ) that the project complies with the associated 401 Water Quality Certification requirements, and complies with the Neuse River Basin (NRB) Buffer Rules. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. The proposed project consists of the widening of Creedmoor Road (Highway 50) needed for the expansion of an additional lane along Creedmoor Road. The City of Raleigh is requiring the property owner to install this additional lane prior to site approval. For this reason, the site does not currently have a final site plan because the owner did not wish to invest the time and money associated with developing such a plan if the Creedmoor Road impacts were not permittable. The project site is approximately 14 acres and is located on the west side of Creedmoor Road (Highway 50), approximately 2000' north of the intersection of Creedmoor Road and Glenwood Avenue (Highway 70). Please refer to the USGS Location Map for the location of the property (Figure 1). The original plan for the proposed road widening impacted 400 linear feet of stream but has since been revised to impact only 111 linear feet of channel. At the request of the applicant, S&EC conducted a detailed wetland delineation and stream buffer evaluation on the property on October 3, 2003. Ms. Debbie Edwards of the NC-DWQ confirmed our buffer determinations on October 30, 2003 (NBRRO 03- 286). Please refer to the attached confirmation letter by Ms. Edwards. The subject site is shown on the applicable Wake County Soil Survey map (Figure 2). A wetland sketch map and DWQ buffer letter are attached in support of the wetland delineation. Because the feature appears to be spring fed, the stream becomes perennial 15 feet from the beginning of the buffered channel. A site meeting was held with Mr. Zarzecki of the NC DWQ to discuss the project and its potential buffer impacts. During this site meeting we waked the portion of the stream where the proposed buffer and stream impacts are planned and observed the existing culverts. This section of stream is immediately adjacent and parallel with the existing Creedmoor Road and is piped under existing road fill in two locations. This stream also has two existing culverted crossings that provide driveway access to the site. One of these crossings will be utilized to provide road access to the site. In an effort to minimize stream and buffer impacts as much as possible, the applicant modified the plan to incorporate retaining walls, and reduced the impact by more than 80%, to 111 linear feet of channel. Proposed mitigation for the perennial stream impacts has been requested from the EEP. Because the impacted stream is being relocated and not piped, S&EC believes that mitigation exceeding a 1:1 ratio would be excessive. The proposed road expansion will cross a portion of one stream channel and a portion of the riparian buffer of the same stream. This stream is adjacent to Creedmoor Road and nearly parallel to the road in a heavily developed area. The impact tables in the PCN itemize and provide a description of each proposed impact to stream channels and riparian buffers. The total proposed impact to the perennial stream channel is 111 linear feet. The total proposed impact to riparian buffers are 19,086 ft2 in zone 2 and 6,739 ft2 in zone 1. Within the total proposed buffer impacts, Zone 1 impacts of 731 ft2 and Zone 2 impacts of 195 ft2 result from a perpendicular crossing and therefore should not require mitigation. Please refer to the attached Impact Maps (5 sheets) for the location of each impact. Because these areas are parallel road impacts, buffer mitigation is assumed. The client proposes payment to EEP to meet the buffer mitigation requirements. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. This proposed widening will result in 19,086 ft2 of zone 2 buffer, 6 6,739 ft2 of zone 1 buffer and 111 feet of stream impact to a stream adjacent to Creedmoor road The Creedmoor Road widening is required by the City of Raleigh in order for the property owner to have any site plan approved. The site plan has not been finalized but will not require any additional impacts to buffers or jurisdictional waters. 11. Explain the purpose of the proposed work: The purpose of the work is to widen Creedmoor road (highway 50) as required by the City of Raleigh. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. A site meeting with Ms Debbie Edwards of the NCDWQ was conducted on October 30, 2003 to determine the subjectivity of the stream to the Neuse Buffers (NBRRO 03-286). VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors Page 5 of 8 including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.htrnl. 1. Provide a brief description of the proposed mitigation plan. It was determined that the features shown on the Wake County Soil Survey, but absent on the USGS Raleigh West, NC Quad map could potentially be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A: 02B.0233 (NCAC .0233).
