Re: Division of Water Quality (DWQ) Verification Meeting of the Neuse Buffer Determination for the
property known as the McGuinn Property, Wake County, North Carolina
Dear Mrs. McGuinn:
On September 28, 2006, Ms. Lia Myott, Mrs. Periann Russell of the DWQ, and I reviewed the channel
features on the property. It was determined that feature B will be subject to the Neuse River buffer from
flag S-02 until its confluence with feature A. Feature A was not contested and will be subject to the Neuse
River Buffer throughout its extent on site. Feature C was not present in the field and will not be subject to
any buffers. Ms. Myott will be sending written confirmation of her fmdings.
Neuse River Buffer Rules
The Neuse River Buffer rules protect up to 50 feet from the edge of existing "surface waters" (intermittent
streams, perennial streams, lakes, ponds and estuaries) found within the Neuse River Basin. The 50-foot
buffer basically consists of two zones. The first zone is measured 30 feet landward from the top bank of
streams and intended to contain anundisturbed-forested area. The second zone is measured 20 feet from
the edge of the first zone and is intended to contain a vegetated buffer. A couple of notable points of the
rules include; the allowance of grading with re-vegetating within Zone 2 (the outer 20 feet) and the
requirement of mitigation for road crossings greater than 150 feet in width and utility lines running parallel
and within Zone 1 of the buffers, Please call if you would like to discuss these rules in more detail.
Additional Services
If you choose to have us perform additional work, the following is a list of additional services: (1)Have us
perform a detailed wetland delineation (2) Obtain sign-off/approval from the USACE of our delineation and
(3) Send notification to the USACE and DWQ regarding proposed impacts to wetlands and permitting
issues, if required. This additional work can be completed at our hourly rates or a proposal can be
generated. Please advise.

On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B .0233)-
EXPRESS REVIEW PROGRAM
On September 28, 2006, at the request of Steven Ball of S&EC, Inc., an on-site determination was conducted to review
two stream features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233).
The features are labeled as "B", "C" on the attached map, initialed by Lia Myott and Periann Russell on September 28,
2006. The Division of Water Quality (DWQ) has determined the following:
^ Feature `~A" is subject to the Neuse Buffer Rule and was not contested by S&EC.
^ Feature "B" is subject to the Neuse Buffer Rule at the Flag labeled "5-03" by S&EC where an
intermittent stream begins at a large headcut.
^ Feature "C" is not subject to the Neuse Buffer Rule since it is an ephemeral feature.
This on-site determination shall expire five (5) years from the date of this letter.
Landowners or affected parties that dispute a determination made by the DWQ that a surface water exists and that it is
subject to the buffer rule may request a determination by the Director. A request for a determination by the Director shall
be referred to the Director in writing c/o Cyndi Karoly, DWQ 401 Oversight/Express Review Permitting Unit, 2321
Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that you receive this letter. Applicants
are hereby notified that the 60-day statutory appeal time does not start until the affected party (including downstream and
adjacent landowners) is notified of this decision. This determination is final and binding unless you ask for a hearing
within 60 days.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor
does this letter approve any activity within Waters of the United States or Waters of the State. If you have any questions,
