After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3404, which may be viewed on our website at http://h2o.enr.state.nc.us/newetlands. This certification allows you to use Nationwide Permit Number 14 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions of Certification: Certification of Completion 1. Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. The culvert shall be installed and maintained as shown on the modified design submitted by Chris Johnson of Withers and Ravenel dated January 9, 2004. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. As discussed in our meeting at your office on January 7, 2004, the proposed design consists of (2) 72" RCP's with one pipe aligned directly with the stream channel and the second pipe offset to the northern side of the stream. A concrete baffle is also proposed at the upstream end of the offset pipe to ensure flows at bank full or less are accommodated by the main 72" pipe aligned with the stream. It is our understanding that your office wants to ensure the contractor installs the baffle correctly and at the location as discussed in our meeting. We have included with this letter a copy of the plan sheet and have highlighted the notes/details that address these issues. We trust this letter and attachment satisfy your office's requests. Worwere requested to provide a response to comment #2 from the DWQ letter dated December 10, 2003. Our response to this comment is as follows: The existing stream channel is approximately 4-feet wide and 2-Feet deep. It lies within a floodplain approximately 200 to 250 feet in width. The upstream watershed from the stream crossing consists of 190 acres. The proposed culverts were designed per NCDOT requirements for a fully developed watershed according to the maximum allowable 301/a impervious surface allowed within the Research Triangle Park. Assuming full build-out, the existing- channel (no roadway) will not accommodate the 1-year storm. Hydraulic assessment indicates the water overflows the banks and fills in the floodplain. The proposed culvert design includes one 72" pipe to be buried one foot in the existing channel and the second pipe offset to the north side of the channel. We have proposed to install a concrete baffle at the upstream end of the offset 72" culvert to ensure that when flows are at bank full or less the water will flow only through the 72" culvert that is aligned directly with the strearh channel. Upstream and downstream improvements are also proposed to transition the channel to the culvert inlets and then from the culvert outlets back to the channel. The downstream banks will be armored with Class II Rip Rap to prevent disturbance of the channel. This bank protection will be utilized most during 1-year storms and less when the water elevation remains below the top of the stream banks. During storm events heavier than the 1-year storm when flows rise above bank full depth, the second 72" pipe offset from the stream channel will also be utilized. During these storms, the water elevation quickly rises above the stream banks both upstream and downstream of the culverts. Therefore, the water flow is not being forced through the 4-foot channel at the downstream end, but is flowing within the floodplain. Due to the proposed channel improvements, water velocities at the culvert outlet for the 2-year and 10-year storms are reduced from the existing build-out condition of 4.5 fps and 4.6 fps to 1.9 fps and 3.5 fps, respectively, Velocities downstream of the channel improvements remain unchanged from the existing build-out condition at 4.2 fps and 4.9 fps. I hope this is satisfactory to address your concerns regarding potential secondary impacts from the construction of the south loop road. In 1986 the Research Triangle Foundation began planning the development of the 2300 acres which comprise the southern portion of the Research Triangle Park. The Foundation contracted with the School of Design at N.C. State University to prepare a land plan for this area. Instructions to the School of Design were to prepare "the best plan possible" for this land - a plan which would accommodate research uses but which would be an environmentally responsible plan. The Foundation recognized that our land included floodplains, wetlands, steep slopes, wildlife (although mock environmental impact studies conducted by the School of Forestry at N.C. State University have not found any rare or endangered species) and was in the upper reaches of the watershed for Jordan Reservoir. The plan, prepared by the School of Design and currently under implementation by the Foundation, provides for a significant amount of land to be placed in permanent open space. For our purposes, this open space is designated as either "Natural Area Preserve" or "Surface Cover Maintenance Areas". The Natural Area Preserve encompasses the floodplain and wetland areas associated with the streams which cross the property. In many areas the Natural Area Preserve includes additional wooded areas beyond the actual floodplains. Areas of steep slopes and drainageways on the adjoining lots are designated as "Surface Cover Maintenance Areas" which will be retained in existing vegetation to reduce the potential detrimental effects of erosion and sedimentation during construction on these sites and to help infiltrate stormwater run-off from these sites after development. Surface Cover Maintenance Areas are defined by easements on the plats when the lots are transferred. An estimated 500 of our 2300 acres will be in Natural Area Preserve and an DEVELOPERS OF THE RESEARCH TRIANGLE PARK Mr. John Dorney Page 2 December 19, 2003 estimated 260 acres will be in Surface Cover Maintenance Areas. In addition, lot coverage (i.e., impervious surface) is limited to 30%. (Please note that the Foundation was planning for limitations on impervious surfaces long before the State regulations called for a five mile protected area around Jordan Reservoir.) . Also note that the over all project will be less than 30% impervious surface as we estimate that approximately 230 acres of the Natural Area Preserve will not be assigned to adjacent lots for the purpose of calculating the permitted impervious surface. In addition, both Wake and Durham Counties have adopted requirements for stream buffers which are applicable to the respective portions of RTP. Finally, all of the public roads in RTP are built without curb and gutter. The use of sheet flow and grassy swales for road run-off has been a policy of RTP for the past 44 years. The plan prepared by NC State School of Design also called for construction of a series of lakes. These lakes were intended to retain at least the first 1/2 inch of stormwater run- off to further protect the quality of the stormwater leaving our property. To date, two of these lakes have been constructed and the third and final lake is nearing completion of design and permitting (the 401 permit has already been issued) and we expect to start construction on it this spring. We believe the extension of South Loop Road to Davis Drive is important to assuring adequate east-west traffic circulation for this portion of RTP. This will allow traffic from the lots which adjoin South Loop Road to disperse between two major thoroughfares: Davis Drive and Louis Stephens Drive. Without the Davis Drive connection and until Louis Stephens Drive is connected south to Cary, traffic would be forced to take a very circuitous route via Louis Stephens Drive to Kit Creek Road and then travel east to Davis or west to NC 55. The Corps has been provided with correspondence previously from NCDOT and the project engineer concerning the need for the project and impact minimization an additional justification letter from Withers and Ravenel dated 11/26/03 is attached. All mitigation required for the permitted impacts (including those not yet completed) will be performed at the Mt. Vernon Springs mitigation site in Chatham County. This site is projected to yield 4567' of stream mitigation based on plans already approved by DWQ and the Corps. So far 768' was used for Louis Stephens Road and 3308' for a RTP Lake. This project will utilize 259' at a 1:1 ratio leaving 232' of credit remaining at Mt. Vernon Springs. The Corps has agreed to a 1:1 mitigation ratio for this impact. The proposed South Loop Road begins at the southern terminus of Louis Stephens Drive and runs southeast across the proposed Northern Wake Expressway, crosses an unnamed tributary of Kit Creek, and connects to Davis Drive (SR 1999). Please refer to the attached map (Figure 1) for the location of the proposed connector road on a USGS topographic quadrangle. S&EC delineated the wetlands and stream channels adjacent to and crossed by the project. Mr. Eric Alsmeyer of the USACE verified the delineation on June 28, 1999. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to Page 9 of 13 I freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Pennits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. As depicted in the wetland impact maps, the proposed construction will impact 259 linear feet of existing stream channel. This length includes the 86-foot roadway, fill slopes, and required inlet/outlet improvements and/or riprap dissipators. The proposed construction at the stream crossing location will consist of a five lane divided roadway designed in accordance with NCDOT standards and specifications using the NCDOT Highway Design Manual (2002 edition) and the NCDOT Roadway Standard Drawings Qanuary 2002 edition). The median width of the roadway at the proposed stream crossing is 15 feet, which will provide room for future expansion of one additional traffic lane without additional future impacts to the stream. An increase in traffic should be expected as the development of adjacent parcels in the RTP are completed. Removal of the median at the stream crossing would require constricting the traffic lanes closer together immediately prior to the Davis Drive intersection. This situation is often referred to as "bottlenecking" and causes increased traffic congestion. Davis Drive is a major thoroughfare that provides direct access to and from RTP, therefore, maintaining smooth traffic flow at this intersection is vital to the transportation system in this area. The fill slopes at the stream crossing were increased to 2:1, the maximum allowable slope per the NCDOT Highway Design Manual. NCDOT headwalls (NCDOT Std. 838.40) were also used at both ends of the culverts to minimize disturbance of the stream. Channel improvements and/or rip rap velocity dissipators are proposed upstream and downstream of the culverts to create smooth ties from the culverts to the stream channel. W&R Project No. 98184 Dear Todd: This letter is in response to our meeting at your office on August 11, 2003 regarding the stream crossing on the above referenced project. As you know, the stream crossing is located near Davis Drive at Sta. 13+00+/- of the proposed roadway alignment. Since this project dates back a few years we would like to give a brief summary of the permitting and design process that Research Triangle Foundation has completed so that you may have a better understanding of the steps taken over the course of this project. The stream crossing on this project was delineated by Soil & Environmental Consultants, Inc. and surveyed by W.K. Dickson. The delineation survey was approved by your office on June 28, 1999 by Eric Alsmeyer. Following the delineation survey, Withers & Ravenel, Inc. analyzed the culvert crossing during preliminary design of the project. Please note the preliminary hydraulic design for the stream crossing was calculated using the NCDOT Guidelines for Drainage Studies and Hydraulic Design, 1990 edition. Using this design, a 72" RCP was selected as the pipe size for this crossing. Withers & Ravenel requested a cost estimate from Contech for a hydraulically equivalent bottomless alternate. Contech recommended using a 10'X 5'-2" Structural Plate Arch Culvert and estimated the cost to be approximately $58,500. This estimate was based on using a typical 4' X 1.5' concrete strip footing since no geotechnical data had been provided at that time. The 72" RCP was estimated to cost approximately $38,000, which gave approximately a $20,000 cost difference between the tt liatrves-Follavuing the preliminary estimates, 138-E T raparad a Nationwide Permit-date anuary 17, 2001 that included this stream crossing and other impacts for the Louis Stephens Roa roject. The permit indicated the use of a bottomless culvert an was aPP fft During final design, the culvert crossing was re-analyzed by Withers & Ravenel, Inc., due to an updated design manual from NCDOT. The new design was based on the NCDOT Guidelines for Drainage Studies and Hydraulic Design, 1999 edition. The design methodologies for large urban drainage areas were more conservative in the 1999 edition than the previously used 1990 edition. It was also determined that the pipe would be designed to accommodate the storm flows of the total build-out conditions for the existing drainage area (190 acres) so that the culvert would not require removal/replacement prior to the life-span of the culvert. Two bottomless alternates were selected based on the hydraulic efficiency and were further examined in this report. The first alternate was a 14' X 7' Conspan Concrete Arch Culvert. The second alternate was a 19'-5" X 6'-9" Contech Super Span Low-Profile Arch Culvert. Contech required the use of a low profile arch due to cover constraints of the roadway and this size was the smallest low profile arch supplied. The culvert report including these bottomless culvert alternates was submitted to NCDOT in December 2000. The reason for disapproval was the excessive future maintenance costs of NCDOT for future replacement of the structure compared to that of a less expensive pipe crossing. Following the disapproval, Withers & Ravenel Inc. submitted a second culvert report, dated April 2003, which analyzed dual 72" RCP's for the culvert crossing. The dual 72" RCP's were determined to be the hydraulic equivalent to the bottomless culverts submitted in the previous report. This report was approved by the NCDOT Hydraulics Unit on June 16, 2003. Following the approval, Research Triangle Foundation directed S&EC to submit for a revised permit through your office. Your office requested a meeting of all parties to discuss the bottomless culvert alternates that were disapproved by NCDOT. During our meeting on August 11, an agreement was made to have geotechnical borings taken at the culvert location so that the bottomless culvert alternates could be analyzed from a constructability and economical standpoint. These were. the two major issues from NCDOT for disapproving a bottomless culvert. Since our meeting, the geotechnical borings have been completed and a report prepared by Geotechnologies, Inc. The report illustrates that partially weathered rock was found at depths ranging from 8 feet to 12 feet below the top of the stream bank. A copy of the report has been attached for your reference. Following receipt of the report, Withers & Ravenel, Inc. forwarded the information to Bridgetek (Retailer for Conspan Systems) and Contech Construction Products, Inc. for their review and to aid in finalizing footing designs and cost estimates for the two bottomless culvert alternates that were previously disapproved by NCDOT. Please note that during the review, Bridgetek recommended upsizing to a 24' X 7' span for constructability. reasons to prevent disturbance of the existing stream channel during installation. The estimated cost for this alternate increased to $232,335. The alternate. from Contech remained a 19'-5" X 6'-9" Super Span. Low Profile Arch, however, the estimated cost for this option was increased dramatically to $260,000. This cost increase was due to the larger headwalls/wingwalls and a deeper footing design than was previously estimated for the original 10' X 5-2" arch culvert analyzed during preliminary design. Please refer to the attached cost estimates for further clarification. We have estimated the total cost of dual 72" RCP's w/ Concrete Headwalls to be approximately $60,000. As you can see, the cost difference compared to the preliminary design has increased from $20,000 to approximately $200,000. Therefore, we would like to request that a revision be allowed to the existing Nationwide Permit to allow the use of the. dual 72" RCP's.
