APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules.(15A NCAC 213.0233) with ADDITIONAL CONDITIONS
To Whom It May Concern:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.089 acres of wetlands, 145 feet (125 feet of temporary impacts and 20 feet of permanent impacts) of
perennial streams, 67 feet of intermittent streams (permanent) and 48,880 square feet (ft) of protected riparian buffers
for the purpose of constructing the stormwater wetland, as described within your application dated April 14, 2003. After
reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ)
General Water Quality Certification Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide
Permit(s) 18 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213.0233. In addition, you should
obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project
including (but not limited to) Erosion and Sediment Control. Also, this approval will expire when the accompanying 404
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.
Conditions:
1. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
2. Water Quality Certification
The proposed project must comply. with all of the conditions of General Water Quality Certification (GC) 3402.
3. Stormwater Wetland
The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in
perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the
Division of Water Quality.

Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
Any disputes over determinations regarding this. Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the
Neuse riparian buffer protection rule as described within 15A NCAC 2B .0233. If you have any questions, please

The purpose of this letter is to request approval for our clients to utilize Nationwide
Permit 18 for the project known as Spring Branch Wetland Facility. The property (±4.83
acres) is west of Second St., south of Hwy 70 and east of the Neuse River in Smithfield,
NC. The site is shown on the attached plans and USGS Topo Quad vicinity map. On
March. 31, 2003, Mr. John Thomas approved the wetland delineation performed by
S&EC, PA. The owner and applicant is The Town of Smithfield.
Impacts totaling 0.089 acres of vegetated wetland 0.004 ac of intermittent channel, and
145 linear feet of perennial Stream are proposed (see impact maps sheet C-3) for the
facility. The NW 18 impact occurs at the upper most portion of a wetland "finger" and
no jurisdictional wetlands or waters are upstream from the proposed impact. The purpose
of the project is to provide Stormwater "treatment" for waters, which currently do not
receive and are not required to receive any treatment.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction

VI. Proposed Impacts to Waters of the United States/Waters of the State
It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to
wetlands, open water, and stream channels associated with the project. The applicant must also
provide justification for these impacts in Section VII below. All proposed impacts, permanent
and temporary, must be listed herein, and must be clearly identifiable on an accompanying site
plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a
delineation map, whether or not impacts are proposed to these systems. Wetland and stream
evaluation and delineation forms should be included as appropriate. Photographs may be
included at the applicant's discretion. If this proposed impact is strictly for wetland or stream

ephemeral wetland depression and a "ditched" intermittent channel that is maintained in a
mowed herbaceous state to allow construction of a stormwater wetland. Minimal inlet and outlet
structures and stabilization are required along the modified perennial channel. Baseflow will be
maintained in the channel.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
Inlet structures are designed to intercept stormflows only so that stream base flow is not
adversely impacted This is the only property the town owns that is suitable for the specified
purposes The facility is designed "off-line: to minimize the impacts.
VIII. Mitigation

DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http:/A12o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
Mitigation should not be required by DW or USACE because impacts are below
thresholds and/or temporary. The stormwater wetland being created will be larger than the
low quality wetland impacted and will provide an improvement to downstream water quality.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the

If buffer mitigation is required, please discuss what type of mitigation is proposed (i.e., Donation
of Property, Conservation Easement, Riparian Buffer Restoration / Enhancement, Preservation or

Based on an office meeting with Todd St. John and Bob Zarzecki of DWQ, buffer mitigation will
not be required since a stormwater wetland is an allowable use and impacts are temporary since
the entire 50' buffer will be revegetated.

PROJECT LOCATION:
The proposed Spring Branch Wetland Facility is located in the Town of Smithfield, Johnston
County, North Carolina. The specific location of the facility is adjacent to and just north of
Spring Branch, a tributary of the Neuse River, immediately downstream of the crossing with
Second Street near downtown Smithfield. Spring Branch confluences with the Neuse River just
downstream of the project site.
PROJECT DESCRIPTION:
This project consists of the creation of a stormwater wetland by the Town of Smithfield to aid in
the improvement of the water quality of the stormwater runoff from the Spring Branch watershed
and therefore the Neuse River and to serve as an educational facility to improve the public
understanding of the need and function of stormwater Best Management Practices (BMPs).
Specifically, this project is anticipated to highlight the benefits of wetlands to treat stormwater
and serve as a public education opportunity once it is linked with a future greenway system. The
town and the North Carolina State University Extension Specialist originally conceived the
project and obtained Clean Water Management Trust Fund approval to bring it to fruition. The
project area is approximately a five (5) acre portion of a tract of land owned by the Town of
Smithfield.
The primary function of the stormwater wetland facility is to provide treatment of runoff
generated within the Spring Branch watershed. The watershed of approximately 650 acres
contains much of the new commercial development located within Smithfield. An existing
stormwater pond is located upstream of the project and serves to attenuate the peak stormwater
discharge as well as provide treatment of the stormwater runoff from the upper half of the Spring
Branch watershed. The proposed wetland facility will provide treatment for the stormwater
runoff from the entire watershed, serving as a primary benefit to the runoff from the lower half of
the watershed but also furthering the treatment of runoff from the upper half of the watershed.
The location and configuration of the proposed wetland facility will allow for a pedestrian path to
be created adjacent and parallel to the top of the retaining wall. The project will also incorporate
viewing and seating areas around the wetland as well as improved parking in the area of an
existing gravel parking lot in the northeast comer of the site. All of these measures will enhance
the value of the wetland facility as an educational resource for the public.
The wetland facility will be a shallow water wetland that will maintain a permanent pool of
shallow water (maximum depth of 1 ft) as well as allow for approximately four (4) feet of
temporary storage above the permanent pool to provide treatment of the "first flush" runoff
volume generated by various storm events. The temporary storage volume is created by the
construction of an earthen berm that parallels Spring Branch and a two tiered retaining wall that
parallels the northern boundary of the site. The preliminary design allows for the storage of a
volume of runoff that approaches the volume that would result from the 1" rain event over the
entire watershed or greater than the 1" volume for the lower half of the watershed. This "first
flush" runoff is considered to contain the highest concentration of suspended solids as well as
other pollutants typically found in a developed watershed. The wetland facility is designed to
release the stored volume of water within 2 to 5 days.

The collection of the first flush runoff will be achieved by constructing a berm in Spring Branch
channel such that water rising above the elevation of the stream base flow will be diverted to the
wetland facility until the water reaches the elevation of the temporary storage pool. After water
reaches this elevation, it will be allowed to overflow the berm in the channel and continue
flowing downstream. The berm is to be constructed with an open conduit, most likely a small
pipe, to allow for the passage of base flow in the stream.
NEUSE BUFFER IMPACTS:
Zones 1 and 2 of the Riparian Buffer will be impacted by this project. The impacted riparian
buffer area within the project limits (approximately 1.12 acres) will be re-graded and replanted as
part of the project. The existing buffer areas contain some wetland areas, trees, and mostly thick
grassy brush and shrubs as well as mowed grass area.
The project will result in a buffer area containing wetland species as well as new trees and shrubs.
Vegetation will be restored to the area with extensive plantings. The proposed facility berm that
parallels the stream is to be planted with low shrubs providing a screen when viewing from across
Spring Branch. Native tree species are to be planted within the wetland facility as well as the
areas around the facility. In addition, the proposed tiered retaining wall will provide a terrace for
planting along the length of the wall.
The only proposed structures within the riparian buffer are components of the inlet and outlet
devices for the wetland facility. These include earthen berms stabilized with stone, piping needed
for the facility inflow and outflow devices, and pipe outlet protection.
WETLAND AND STREAM IMPACTS:
The project site contains approximately 5522 SF of existing wetland area. This area is the sum of
two (2) separate delineated wetland areas. An intermittent channel located in the eastern portion
of the project area comprises 167 SF of the total area, and the remaining 5355 SF is the area of a
wetland located in the western portion of the project area that is connected to Spring Branch.
The proposed project impacts to the existing wetland areas include the entire area of the
intermittent channel and a portion of the wetland area located in the western portion of the project
area. The total area of the proposed wetlands impacts is approximately 4032 SF or 0.093 AC.
The proposed wetland facility will contain many native species of wetland plants and provide a
larger wetland area than is existing. A small diameter plastic pipe is to be installed through the
facility berm to provide hydraulic connectivity between the remaining existing wetlands and the
proposed wetland facility.
The stream impacts include the measures needed to facilitate the inlet and outlet devices for the
wetland facility. The impact resulting from the installation of the inlet device includes the
construction of a berm in the channel as well as the grading of a portion of the stream channel the
stream bank to aid in the diversion of runoff to the wetland facility. This impact measures
approximately 125 LF. The channel berm is necessary to direct the "first flush" runoff to the
wetland facility. The provision of a flow passage by way of a small plastic pipe or similar device
would maintain the passage of base flow in the stream. The height of the berm (approximately 4-

5 feet) allows for water above the elevation of the temporary storage pool in the wetland facility
to bypass the facility and continue to flow downstream in the channel.
The impact resulting from the construction of the outlet device includes the installation of the
outlet pipe, which will extend into the channel bank as well as the placement of rip rap outlet
protection at the pipe outlet. The rip rap material will be installed in the stream bank and partly
in the channel. This impact will measure approximately 20 linear feet.
The total length of the proposed stream impacts is 145 linear feet measured along the centerline
of the stream channel.
ADDITIONAL INFORMATION:
The drawings submitted as part of the PCN application do not include the final landscaping plans.
Landscaping plans for the wetland facility and surrounding area are to be prepared as part of the
construction drawings for the project. A conceptual plan showing typical plantings through a
section of the wetland facility is included as part of the PCN application drawings.
A formal erosion control plan will also be prepared for submittal to NCDENR-Diversion of Land
Resources, Land Quality Section for review and approval. This plan will be included as part of
the construction drawings for the project.
